The Regional Ministry of Science, Industry and Employment of the Principality of Asturias has opened a public information period regarding the file for the declaration of public utility of the list of affected assets and rights and the subsequent compulsory expropriation via urgent procedure of the PE-72 “Ouroso” wind farm, promoted by Terranova Energy Corporation, S. A. The resolution, dated September 29, 2026, is published in the Official Gazette of the Principality of Asturias (BOPA) no. 198, of October 14, 2026, with reference Code 2026-08109. Interested parties have 30 business days from the day following publication to examine the project and submit allegations.

The application was submitted in full on September 22, 2026, by the promoting company and is being processed under file number AUTO/2022/2977 (PE-72-DUP). The competent body for the specific declaration of public utility is the Regional Ministry of Science, Industry and Employment, through the General Directorate of Energy and Mining, by virtue of Law 24/2013, of December 26, on the Electricity Sector. The announcement is subject to public information in accordance with Article 33 of Decree 43/2008, of May 15, on procedures for the authorization of wind farms by the Principality of Asturias, and Articles 143 and 144 of Royal Decree 1955/2000, of December 1.

The procedure is initiated because the applicant has been unable to reach prior agreements with all landowners or there are formal doubts regarding the documentation proving ownership. The announcement is signed in Oviedo, on October 1, 2026, by the Head of the Renewable Energy and Energy Efficiency Service.

Allegations must be submitted in writing to the Department, for the purpose of rectifying possible errors in the list or opposing the declaration of public utility of the installations.

Effects of the declaration of public utility

According to Article 56 of Law 24/2013, of December 26, on the Electricity Sector, the declaration of public utility shall in all cases imply the need for occupation of the assets or acquisition of the affected rights and shall entail urgent occupation for the purposes of Article 52 of the Law of December 16, 1954, on Compulsory Expropriation. Furthermore, it will entail the right to obtain authorization for the establishment, passage, or occupation of the electrical installation on lands of public domain, use, or service, or assets of the State or the autonomous communities, as well as on assets of public use, owned or communal assets of the province or municipality, their works and services, and public easement zones.

The resolution recalls that the competent body for the specific declaration of public utility of this project is the Department of Science, Industry, and Employment, through the General Directorate of Energy and Mining.

The opening of this procedure directly affects property owners in western Asturias, who see the occupation of their land placed on the urgent track provided for in expropriation legislation. The period of 30 business days is the only window to review the list of affected properties, correct cadastral or ownership errors, and submit allegations before the declaration of public utility is resolved.
