The Territorial Delegate for Industry, Energy Transition and Sustainability of Álava, Javier Aizpuru Ochoa de Eribe, has signed the resolution to archive the Igebelar Solar photovoltaic solar plant and its sectioning center. The decision was taken at the request of the company Ventaja Solar 8, S.L., and was published in the BOPV gazette on October 8, 2026, with official reference 2026/4166. Consequently, the 3.614 MWp installation planned for the municipalities of Ayala and Amurrio will not proceed.

The company itself requested the archiving

According to the resolution, the company Ventaja Solar 8, S.L. requested the archiving of the file twice: on July 23 and August 31, 2026. The company argued that the project could not be processed due to the conditions established in the environmental impact statement and obstacles arising during the consultation process; the administration has accepted this situation as an insurmountable impossibility.

The request for archiving affects the entire file, that is, both the photovoltaic plant and the sectioning center located in the municipality of Amurrio. The sectioning center has the number 2471491.

Two and a half years of processing

The project’s trajectory has been long:

  • November 27, 2023: The company Ventaja Solar 8, S.L. requested prior administrative authorization.
  • June 13, 2025: The territorial delegate of Álava granted the prior administrative authorization.
  • August 4, 2025: The authorization was published in issue number 87 of the BOTHA gazette.
  • August 12, 2025: The authorization was published in issue number 151 of the BOPV gazette.
  • July 23 and August 31, 2026: The company requested the archiving.
  • September 21, 2026: The resolution to approve the archiving was signed.

The official file number is 01 GEY 202300046.

The resolution cites Article 20 of Decree 410/2024 (December 3), which grants the territorial delegation of Álava the competence to process and resolve the file. Likewise, Decree 48/2020 (March 31), which regulates the authorization procedures for electricity production, transmission, and distribution installations, and Law 21/2013 (December 9), regarding environmental assessment, were taken into account, as well as Law 10/2021 (December 9), regarding the environmental administration of the Basque Autonomous Community.

The archiving is based on Article 94 of Law 39/2015 (October 1): the interested party may withdraw their request, and the administration will accept the withdrawal and consider the procedure finished, provided that third parties do not request its continuation within a period of ten days.

Appeal available

The resolution does not exhaust the administrative route. Therefore, interested parties may file an administrative appeal (recurso de alzada) before the Director of Decarbonization, within one month starting from the day following the receipt of the notification, in accordance with Article 121 and following of Law 39/2015.

Impact

Archiving does not mean that the project has failed permanently, but rather that the company itself has considered it unfeasible in the face of strict environmental conditions. The case shows that the conditions of the environmental impact statement have a decisive weight in the processing of renewable energy projects, and that the debate regarding land use in the small municipalities of Álava remains active.
