Huesca rectifies a nursery scholarship and denies it because the center is unauthorized
Por FactBox Admin

The Huesca City Council has rectified the resolution for scholarships for the first cycle of early childhood education and nurseries for the 2026/2027 academic year to deny one of the admitted applications, after verifying that the minor was enrolled in a center without authorization to provide that educational level. The correction was approved via Decree 6313/2026, issued by the Mayor’s Office-Presidency on October 27, 2026, and published in the Official Gazette of the Province of Huesca (BOPH) No. 209, on Friday, October 30, 2026, in the Local Administration section. The resolution bears the signature of the mayor, Lorena Orduna Pons.
A call already resolved and two corrections
The grants are governed by the general ordinance regulating the granting of subsidies of the City Council, approved by the Plenary of the Huesca City Council on February 24, 2016. The call for the 2026/2027 academic year was approved via Mayoral Decree 2818/2025, dated May 29, 2025, and its extract was published in BOPH No. 100, on May 29, 2026.
The resolution of the call was formalized with Mayoral Decree 5576/2026, dated September 22, 2026. That text had already been corrected once: Decree 6046/2026, dated October 13, published in BOPH No. 202 on October 21, 2026, corrected the omission of eight beneficiaries in the first section, with the following amounts:
- 21276/2026, Gracia Llinares: €100.00
- 22857/2026, Pasaíso Pueyo: €35.00
- 22396/2026, Cerezo Moreu: €35.00
- 21992/2026, Lalaguna Domínguez: €50.00
- 22073/2026, Betato Araguas: €70.00
- 23655/2026, Boix Larrey: €100.00
- 23384/2026, Reyes Mena: €100.00
- 22356/2026, Monclús Cot: €100.00
The chronology of the file
According to the account in the decree itself, on June 15, 2026, Diogenes Cruz Junior submitted the scholarship application for his son, accompanying, among other documents, the enrollment certificate from Kid’s Garden. The application was admitted, but the instructing body, aware of the closure of that center, requested a new center by telephone to continue the processing.
On July 4, 2026, under registration 26322/2026, the interested party provided the enrollment certificate for Colegio San Viator. The decree expressly acknowledges that, due to an error by the instructing body, it was not verified in the second instance that the center met the criteria of the guidelines. The anomaly was detected later, when the grant decree had already been approved and payments to the centers were being processed: it was then verified that San Viator lacked the authorization from the Educational Administration of the Government of Aragon to provide the first cycle of early childhood education at the time of the application.
What Article 3 of the guidelines requires and what is resolved
Article 3 of the call limits the status of beneficiary to fathers, mothers, guardians, or persons in charge of the care of children under three years of age enrolled in private centers authorized by the Educational Administration of the Government of Aragon to provide the first cycle of early childhood education and nurseries in the city of Huesca, provided they are not totally or partially supported by public funds at that level.
The operative part of Decree 6313/2026 establishes:
- To rectify the scholarship resolution of Mayoral Decree 5576/2026 and deny the application of Diogenes Cruz Junior, registered under number 23052/2026, for failure to comply with Article 3 of the rules.
- To remove the applicant from the first point of the granting decree and include them in the second section of denials, with the mention “ART.3. Not enrolled in an authorized private center”.
- To communicate the content of the resolution to the interested party.
- To maintain the full validity, effectiveness, and force of the remainder of the unmodified resolution.
The text of the operative part identifies the corrected decree with the date of September 22 in one point and October 22 in another, an internal discrepancy that coexists with the correct reference to the September resolution.
Legal basis and publicity
The City Council relies on Article 21.1.m) of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, and Article 109.2 of Law 39/2015, of October 1, on Common Administrative Procedure, which allows for the rectification at any time, ex officio or at the request of the interested parties, of material, factual, or arithmetic errors in its acts. The mayor’s competence derives from Article 30.1 of Law 7/1999, of April 9, on Local Administration of Aragon.
The decree orders the publication of the resolution in the Official Gazette of the Province of Huesca, in the National Grants Database, and on the municipal electronic office, without considering it mandatory to notify the interested parties, and to forward it to the affected persons and departments.
The case leaves a practical warning for families: the scholarship is granted to the applicants, but paid to the centers, so that the verification of the center’s administrative authorization conditions the effective collection of the aid. The rectification affects both the excluded applicant and the involved centers and necessitates extreme verification in the second instance of the requirements of the rules.
