Higueruela fija las tasas de guardería y residencias de ancianos

The Higueruela City Council has finalized the modification of the fiscal ordinance regulating the tax for assistance and stays in nursing homes and elderly residences, nurseries, hostels, and other establishments of a similar nature. The agreement is published in the Official Gazette of the Province of Albacete number 123, corresponding to Wednesday, October 21, 2026, in the third section (Local Administration), page 31, with the official reference 26.260. The regulation comes into force the day following its publication, that is, October 22, 2026.

The text reaches the gazette after the provisional plenary agreement of the council received no claims during the public exhibition period, which automatically elevates it to final status. The full publication is carried out in compliance with article 17.4 of the revised text of the Law regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5, the regulation that serves as the framework for the entire operation.

Nursery: 45 euros per month and free from age two

Article 6 of the ordinance, dedicated to the tax quota, is what sets the amounts that families will pay for children’s stays at the municipal nursery. The announcement literally reproduces the following rate table:

  • Students from 1 to 2 years: 45 euros/month.
  • Students from 2 to 3 years: free.

The free status of the 2 to 3 year bracket makes the nursery a cost-free service for families with children in that age range, while the lower bracket remains subject to a fixed monthly fee of 45 euros. The announcement does not detail additional reductions or bonuses for this service.

The announcement does not quantify stays in residences

The title of the ordinance expressly includes assistance and stays in nursing homes and elderly residences, hostels, and other establishments of a similar nature, so the modification also affects users of these social service resources in the municipality. However, the text published in the gazette reproduces article 6 partially: after the two lines dedicated to the nursery, an ellipsis section appears—«(…)»—which leaves the specific rates applicable to nursing homes and hostels out of the announcement. Those amounts, therefore, do not appear in this Wednesday’s official publication.

Three municipal ordinances in the same gazette

The one for nurseries and residences is not the only fiscal regulation from Higueruela to reach its final wording in issue 123 of the gazette. Two other modifications of city council ordinances are published on the same day:

  • The ordinance for the fee for special education provided at the Universidad Popular de Higueruela, with rates from 25 to 50 euros depending on the teaching hours of each course and 65 euros annually for the toy library for families with one child (reference 26.261).
  • The ordinance for the fee for the use of sports facilities and the provision of municipal services, which includes the gym (70 euro annual pass, 15 euros monthly) and the football field (25 euros per hour and a half) (reference 26.265).

The two signed notifications bear the signature of the mayor, Isabel Martínez Arnedo, and are dated in Higueruela on October 6, 2026.

Entry into force and appeal process

The final provision of the ordinance establishes that the regulation will remain in effect “until its modification or repeal is expressly agreed upon.” Against the agreement, and in accordance with Article 19 of the consolidated text of the Law regulating Local Treasuries, a contentious-administrative appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of Castilla-La Mancha, based in Albacete, within a period of two months starting from the day following the publication of the announcement, according to Article 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.

The decision has an immediate effect on the pockets of families with children enrolled in the municipal daycare and on users of residence and hostel places managed or contracted by the city council, who as of October 22 have a definitive tariff framework and an open period to challenge it before the contentious-administrative courts.
