Higuera de Vargas approves the construction waste management ordinance

The Higuera de Vargas City Council has finalized the Municipal Ordinance regulating the management of construction and demolition waste (CDW) of the municipality, after its initial approval by the Plenary in the ordinary session of June 3, 2026. The regulation, published in the Official Gazette of the Province of Badajoz number 167, of September 1, 2026 (announcement 3444/2026), enters into force the day following its full publication.

The final approval occurs after the expiration of the public information and hearing period for interested parties without any claims or suggestions being presented, in accordance with article 70.2 of Law 7/1985, of April 2, Regulating the Bases of Local Regime. The text is based on the state framework of Law 7/2022, of April 8, on waste and contaminated soils for a circular economy, Royal Decree 105/2008, of February 1, and Decree 20/2011, of February 25, of the Autonomous Community of Extremadura.

Mandatory bonds for major and minor works

The ordinance requires every applicant for a works license, or party interested in a communicated act, to establish a prior bond to ensure the correct management of the generated CDW. Without its deposit, the license will not be granted, and non-compliance empowers the municipal body to suspend the works.

• Major works: bond of 100% of the estimated management cost, with minimums per waste category: €1,000/m³ (category I), €30/m³ (II), €15/m³ (III) and €7/m³ (IV).
• In any case, the bond may not be less than 0.4% of the material execution budget nor less than €100.
• Minor works: bond of 0.4% of the budget, with minimums of €50 (budget up to €1,000), €75 (up to €6,000) and €100 (above €6,000).

Separation and destination of waste

The holder of the waste must maintain it under hygienic and safety conditions and separate it into fractions when the established thresholds are exceeded: 80 t of concrete, 40 t of bricks and ceramics, 2 t of metal, 1 t of wood, 1 t of glass and 0.5 t of plastic or paper and cardboard. CDW must be delivered to an authorized manager, at the clean point (recycling center) or at the municipal collection point (up to one cubic meter), with an accrediting certificate.

The return of the bond requires the presentation of the management certificate, the certificate from the project management, a photocopy of the deposit, and the final works certificate. If the data are not consistent with the management study, the City Council may block the return or execute the bond through subsidiary action.

Sanctioning regime and appeal

The regime of infringements and sanctions is that provided for in articles 107 to 118 of Law 7/2022, in cases within the jurisdiction of local entities, with the proceedings being processed in accordance with Law 39/2015 and Law 40/2015. An administrative appeal may be filed against the finalization of the agreement before the Contentious-Administrative Chamber of the High Court of Justice of Extremadura, based in Cáceres, within two months of publication.

The regulation, signed by Mayor Ángel Cabalgante Delgado, makes builders, developers, and owners of works within the municipality directly responsible for the traceability of their rubble, in line with the objectives of circular economy and the eradication of uncontrolled dumping.
