Herradón de Pinares expropriates 28 square meters due to urgency

The City Council of Herradón de Pinares (Ávila) has initially approved the compulsory purchase via urgent procedure of 28.08 square meters of urban land at Calle Mayor, 2, necessary to execute the “Project for the closing of the wall and completion of the roadway at the entrance to Herradón de Pinares”. The decision was adopted by the Plenary in an ordinary session held on June 22, 2026, and is published in the Official Gazette of the Province of Ávila number 166, dated August 28, 2026, under file number 1709/26.

The publication serves as personal notification to the interested parties in accordance with Law 39/2015, of October 1, on Common Administrative Procedure, and opens a public information period of fifteen days so that those affected may rectify errors or provide reasoned opposition to the occupation.

Purpose of the expropriation

The action responds to the completion of the work executed during the 2025 fiscal year, consisting of the reconstruction of the wall and the expansion of the roadway at the entrance to the town. According to the technical and topographic report, verification following execution demonstrates that the geometric and structural closing of the wall cannot be resolved within the limits of the pre-existing public domain; therefore, it is essential to incorporate the identified surface area into the local public domain.

The proposed surface area has been adjusted to the strictly necessary minimum, in application of the principle of proportionality governing expropriation (Article 9 and concordant articles of the Compulsory Purchase Law and Articles 1 and 15 of its Regulations), and is derived from the topographic survey contrasted against the official cadastral plot map.

Valuation and processing

The valuation of the assets and rights to be expropriated amounts to a total of 1,052.34 euros, broken down as follows:

  • Land for definitive expropriation: 28.08 m² at 30.00 €/m²
  • Temporary occupation: 55.94 m² at 3.00 €/m²
  • Affection premium (5% on the domain, art. 47 LEF): 42.12 €

The processing is supported by the report from the Secretariat and the Technical Services, both dated June 2, 2026, as well as the report from the Comptroller’s Office, which certifies the timely retention of credit for the amount of the fair price. The agreement is adopted by virtue of Article 3.4 of the Regulations of the Compulsory Purchase Law and the urgent procedure regulated in Article 52 of the Law of December 16, 1954.

Public information and next step

The list of assets and owners will be published in the Official Gazette of Castilla y León, in the Official Gazette of the Province of Ávila, in the newspaper “Diario de Ávila”, and on the City Council’s notice board, with individual notification to the interested parties. Once the period for filing objections has elapsed, the file will be forwarded to the Governing Council of the Autonomous Community to declare the occupation of the affected assets as urgent.

The resolution, signed by the mayor-president Miguel Ángel Pozo Martín on August 14, 2026, will allow for the completion of a work of municipal interest that remained unfinished, guaranteeing the continuity of the wall and the correct completion of the perimeter fencing between the public domain and the private plot.
