Hellín removes article 19 of the public price for home care assistance
Por FactBox Admin

The Hellín City Council has definitively approved the removal of Article 19 of the Regulatory Ordinance-text no. 6 regarding the public price for the provision of home care services in the municipality. The agreement, initially adopted by the Corporation’s Plenary on August 31, 2026, became definitive as no allegations were submitted during the public exhibition period and is published in the Official Gazette of the Province of Albacete no. 125, dated October 26, 2026, in the third section (Local Administration), page 18, under document number 28.622.
The announcement, signed by Mayor Manuel Serena Fernández, closes the ordinary procedure for modifying a public price ordinance: provisional approval in a plenary session, public exhibition of the agreement, and automatic elevation to definitive status when no claims are filed. The initial approval was adopted in an ordinary session of the Corporation’s Plenary on August 31, 2026, and its announcement was published in the Official Gazette of the Province of Albacete no. 103, dated September 4, 2026.
The affected regulation is the one that establishes the economic regime of the municipal home care service—that is, the amounts paid by users for a social and home-based benefit. The approved modification does not rewrite the ordinance nor add articles: it is limited to eliminating one of its precepts, Article 19, according to the literal text reproduced in the announcement itself.
The exact scope of the modification
The text published under the heading “Modification of Regulatory Ordinance-text no. 6. Public price for the provision of home care services in Hellín” contains a single mandate: “Article 19 of the Regulatory Ordinance-text of the public price for the provision of home care services in Hellín is suppressed.”
The announcement does not include the content of the suppressed article, the previous wording of the ordinance, nor a new fee table. Nor does it detail the savings or the economic variation that the removal represents for the service users. The published information is therefore limited to the declaration of the agreement’s definitive status and the literal transcription of the approved modification.
From the August Plenary to the October publication
The processing of the file followed these milestones, according to the announcement itself:
- August 31, 2026: the Plenary of the Corporation, in an ordinary session, initially approves the modification of Regulatory Ordinance-text no. 6.
- September 4, 2026: the provisional agreement is published in the Official Gazette of the Province of Albacete no. 103, opening the period for public exhibition.
- Public exhibition period: passes without any allegations being presented, as stated in the announcement.
- October 26, 2026: the agreement is automatically elevated to definitive and is published in the Official Gazette of the Province of Albacete no. 125, with the full text of the modification.
The same plenary session of August 31 resulted in other regulatory modifications of the Hellín City Council published in the same issue of the gazette, including that of Fiscal Ordinance no. 10 regulating the fee for the use of municipal facilities, referring to gym memberships for sports centers (document 28.611, p. 17).
Deadline and means of appeal
The definitive agreement is a challengeable administrative act. The official announcement specifies the terms of the challenge:
- Means: contentious-administrative appeal.
- Competent body: the Contentious-Administrative Chamber of the High Court of Justice.
- Deadline: two months counting from the date of publication of the announcement, that is, from October 26, 2026.
No other prior means, retroactive effects, or transitional regime for home care assistance files already in progress are mentioned in the published text.
Why it matters
The removal of Article 19 alters the text of the ordinance that determines what users of the home care assistance service in Hellín pay, a benefit aimed at elderly people or those with dependencies who receive care in their own home. The change enters the legal system through definitive approval and official publication, so that interested parties—current users, families, and third-sector entities operating the service—now have a period of two months to decide whether to challenge it before the contentious-administrative jurisdiction.
