Haro gives 15 days to process the urgent demolition of Linares Rivas

The Haro City Council has granted a non-extendable period of fifteen business days to the owners of the property located at Linares Rivas Street, number 2, to provide the ownership documentation and technical commitments necessary to carry out the demolition declared due to imminent ruin. The resolution, issued by the Mayor’s Office on September 11, 2026, and signed by the mayor-president Guadalupe Fernández Prado on September 16, is published in the Official Gazette of La Rioja (BOR) number 181, dated September 21, 2026, with the official reference BOR-A-20260921-III–3589 and document number 202609160124531.

A file open since August

The notification is part of the Imminent Ruin Declaration File number 1886145X, processed by the Haro City Council and referring to a building with nine cadastral references (2739201WN1124S0001MF to 2739201WN1124S0009IX). Among the interested parties are the heirs of María Concepción Jiménez Jiménez and Esmeraldo López Riaño, as well as ownership holders and heirs who are unknown or whose whereabouts are ignored, which is why the notification is carried out via public announcement in accordance with articles 44 and 46 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

The immediate precedent is the resolution of the Mayor’s Office dated August 27, 2026, published in the BOR number 168, dated September 2, 2026 (reference BOR-A-20260902-III–3371), which declared imminent ruin due to the physical danger and the certain risk of detachment and collapse of structural elements onto the public road, as confirmed by reports from the Municipal Technical Services, and ordered the demolition within 48 hours.

What the owners must present

The agreement of the Mayor’s Office details the documentation required within the period of fifteen business days, counted from the day following the receipt of the notification:

  • Proof of ownership and representation: public deed of ownership, minutes of the Community of Assets, or registry certification; failing that, a document or binding legal commitment with the express consent of all registered co-owners.
  • Notarial power of attorney representing the absent co-owners in favor of the applicants.
  • Appointment and acceptance of the Project Management and Execution Management, signed by a competent technician (architect, surveyor, or technical architect) and endorsed by the official college or accompanied by a responsible declaration.
  • Formal commitment to draft the demolition project, or a copy of the professional services contract guaranteeing its urgent preparation.
  • Commitment to designate the Health and Safety Coordinator for the execution phase.

The resolution responds to the document with entry registration R.E. number 10427, submitted on September 2, 2026, by two owners of the community —Natividad Bañares Salinas, together with Francisco José Rodríguez Alonso and Fernando Rodríguez Alonso—, in which they expressed their will to acquire all property shares and to assume the drafting of the project, the management, and the execution of the demolition works to guarantee public safety.

Subsidiary execution and joint costs

The City Council warns that, if the documentation is not provided within the granted period or if an unjustified delay is observed that jeopardizes the safety of people or property, it will proceed immediately and without further formalities to the subsidiary execution of the demolition, in accordance with Article 102 of Law 39/2015. The economic costs of the technical work, urgent security measures, and the subsequent demolition will be charged in full and jointly to all registered owners, with collection via enforcement proceedings in case of non-payment.

Against this resolution, which concludes the administrative process, an optional appeal for reversal may be filed before the same body within one month from the day following its publication in the Official State Gazette, or a contentious-administrative appeal may be filed before the Contentious-Administrative Court of Logroño within two months, according to Law 29/1998, of July 13. The complete file is available to interested parties at the municipal offices at Plaza de la Paz, 1, in Haro.

A demolition affecting the entire community

The notification directly affects the co-owners of a property with dispersed ownership and untraceable heirs, who now face a decision with joint economic consequences: assume the demolition or let the City Council execute it and pay the costs via enforcement proceedings, with the property pledged for payment. The case illustrates the narrow margin that regulations grant local administrations when ruin threatens the public road and the property is fragmented or untraceable.
