Guardamar definitively approves the coexistence ordinance and its sanctions regime
Por FactBox Admin

The City Council of Guardamar del Segura has definitively approved the modification of the Municipal Ordinance on Citizen Coexistence in Public Spaces, which establishes the regime of infractions and sanctions applicable in the municipality. The announcement of the definitive approval is published in the Official Gazette of the Province of Alicante number 192, dated October 8, 2026, under reference 7604/2026, after no claims were filed during the public exhibition period.
The Plenary of the City Council, in an ordinary session held on August 7, 2026, agreed to the initial approval of the text. Since no allegations were presented, the agreement was automatically elevated to definitive status in compliance with article 70.2 of Law 7/1985, of April 2, regulating the Bases of the Local Regime. The announcement is signed by the mayor, José Luis Sáez Pastor.
The regulation applies to the entire municipal district and repeals the previous municipal ordinances on “Citizen Coexistence” and “Regulation of the Undue Consumption of Alcoholic Beverages.” The full text, consisting of 28 pages, includes an annex with the table of infractions and the amount for each conduct.
Minor infractions: fines of up to 750 euros
The bulk of the catalog is classified as a minor infraction, with a fine of up to 750.00 euros. Among the punished behaviors are:
- Engaging in conduct that shows contempt for the dignity of other people, whether by deed, in writing, or verbally.
- Exhibiting discriminatory behaviors of xenophobic, racist, sexist, or homophobic content.
- Offering games in public spaces involving bets with money or assets without authorization.
- Practicing games with instruments that endanger the physical integrity of users.
- Performing acrobatics with skates or skateboards outside of designated areas.
- Engaging in begging with coercive or harassing attitudes, or performing valet parking activities without municipal authorization.
- Providing unauthorized services such as tarot, clairvoyance, massages, tattoos, or mime.
- Camping or sleeping on public roads and spaces, washing vehicles or clothes on public roads, or abandoning mattresses.
Assaults, betting, and alcohol: serious infractions
Serious infractions are penalized with a fine from 750.01 to 1,500.00 euros. Included in this bracket are behaviors involving assault or harassment of minors carried out by groups in urban spaces, the offering of bets with a risk of loss higher than usual—and in any case, the game of “trile” (shell game)—reckless driving with skates or skateboards on sidewalks, and begging carried out accompanied by minors or persons with disabilities.
The chapter dedicated to the consumption of alcoholic beverages refers to Law 10/2014, of December 29, on Health of the Comunitat Valenciana, with fines of up to 15,000.00 euros. The sale and consumption on public roads are prohibited except in authorized places or during patron saint festivals, as well as the sale in establishments between 10:00 PM and 7:00 AM.
The conducts typified in Organic Law 4/2015, of March 30, on the Protection of Citizen Security are sanctioned according to their tiers: 200.00 euros for minor offenses, 601.00 euros for serious offenses, and 30,001.00 euros for very serious offenses.
20% Reductions, seizures, and judicial appeal
The sanctioning procedure is processed in accordance with Law 39/2015, of October 1. The admission of responsibility and voluntary payment before the resolution each reduce the sanction by 20%, and both percentages are cumulative. The authority to impose sanctions corresponds to the mayor, who may delegate it.
Officers may seize utensils, goods, and money obtained through the infringing activity. Objects not recovered two months after the final resolution will be destroyed or delivered to non-profit entities. Very serious infractions expire after three years, serious ones after two, and minor ones after six months.
A contentious-administrative appeal may be filed against the agreement before the Contentious-Administrative Chamber of the High Court of Justice of the Comunitat Valenciana within two months from the day following the publication of the announcement.
The entry into force of the ordinance provides Guardamar del Segura with a unique sanctioning framework that replaces the two previous regulations and expands the catalog of punished conducts in public spaces, with special attention to the protection of minors, the consumption of alcohol on the street, and unauthorized activities.
