Government orders the handover of four extraditees to the United States

The national Government ordered the delivery to the United States of four Colombian citizens whose extradition had been granted but whose delivery remained suspended due to their participation in the processes of the so-called Total Peace. The decision was adopted through Executive Resolutions 351, 352, 353, and 354 of 2026, signed on September 2, 2026, and published in the Official Gazette number 53,613 of the same date.

The four resolutions, issued by the President of the Republic in exercise of article 491 of Law 906 of 2004, were signed by the Minister of Justice and Law, Iván Alfonso Cancino González, and bear the signature of the head of state, Abelardo de la Espriella. In all cases, the Executive considered that the circumstances justifying the temporary suspension of delivery had ceased, as verifiable contributions and concrete results required for the peace process were not proven.

The four extraditees

  • Willinton Henao Gutiérrez (ID 17775024), extradition granted by Executive Resolution 186 of 2025; he will appear for conspiracy to distribute and import controlled substances and money laundering, in case 23-20070-CR-MORENO/GOODMAN of the United States District Court for the Southern District of Florida.
  • Geovany Andrés Rojas (ID 18188904), extradition granted by Executive Resolution 421 of 2025; he will answer for conspiracy to distribute cocaine and narcoterrorism, in case 25CR0442-H of the United States District Court for the Southern District of California.
  • Carmen Evelio Castillo Carrillo (ID 7603535), extradition granted by Executive Resolution 210 of 2025 for criminal association and manufacture and distribution of cocaine, in case 4:24-CR-71 of the United States District Court for the Eastern District of Texas.
  • Fredy Castillo Carrillo (ID 7632191), extradition granted by Executive Resolution 251 of 2025 for the same charges and before the same Texas court.

Revocation of negotiators and end of the tables

The delivery of the four was conditioned on their contributing verifiable inputs to Total Peace, within the framework of Law 2272 of 2022, as negotiators in different dialogue tables. The Office of the Commissioner Counselor for Peace reported on August 24, 2026, that no concrete results attributable to their participation were proven.

Consequently, the Government revoked their recognition as representative members through Executive Resolutions 342, 345, and 348 of 2026 and terminated the dialogue tables with Resolutions 343, 346, and 349 of 2026, corresponding to the General Staff of the Magdalena Medio Blocks Comandante Gentil Duarte, the National Coordinator of the Bolivarian Army (CNEB), and the Conquistadores de la Sierra Nevada Self-Defense Forces (ACSN).

Conditions of delivery

The deliveries will be made effective once compliance with the conditions imposed on the requesting State is verified: the extradited persons shall not be subjected to enforced disappearance, torture, cruel punishments, banishment, life imprisonment, or confiscation, and they must return to Colombia upon completion of their sentence to appear in the criminal proceedings pending against them. In the case of Fredy Castillo Carrillo, who is not currently deprived of his liberty, the delivery will be made effective once his capture is materialized.

The decision does not modify the granting of the extradition, but rather makes effective the previously agreed delivery, and does not prevent Colombian authorities from continuing criminal proceedings against the requested individuals. The measure represents a shift in the Total Peace policy, by lifting the suspension of deliveries that had been granted in exchange for contributions to the dialogue process, and reinforces transnational judicial cooperation with the United States regarding drug trafficking and money laundering.
