Girona revoca els llindars de gratuïtat de la deixalleria municipal

The Plenary of the Girona City Council has partially upheld the appeal for reconsideration filed by the Municipal Group of the Socialist Party of Catalonia against the modification of the public price for the provision of municipal waste management services and has revoked the gratuity thresholds applicable to private users of the municipal waste collection center. Plenary agreement number 2026036155, dated September 14, 2026, is published in the Official Gazette of the Province of Girona no. 191, dated October 5, 2026, with the official reference BOP-2026_0_191_8440 (edict 8440, pp. 1-9).

File 2026023277 resolves an appeal in which the Plenary considers that a contradiction exists between the regulatory text of the public prices and Annex 1 of the Municipal Waste Management Ordinance, a contradiction that could lead to “a situation of uncertainty regarding the maximum gratuity limits in force” and, therefore, regarding the application criteria for public prices for the use of the waste collection center by private users. The agreement consists of four points: partially upholding the appeal, partially revoking the regulatory text, publishing the consolidated text in the BOP, and notifying the resolution to Ms. Beatriz Esporrin Palacios (NIF ***6470), on behalf of the socialist group at the Girona City Council. The document is signed by Lluc Salellas Vilar on September 18, 2026.

A contradiction between the public price and the ordinance

The published consolidated text maintains that the use of the municipal waste collection center by domestic users is free of charge within the established quantitative and qualitative limits, as the cost of the service is already included in the waste tax. When domestic users exceed these limits, the provided additional public prices are applied.

The gratuity limits for private individuals are set, among others, at:

  • Passenger car tires: 5 units per year.
  • Uncontaminated vegetable oils: 100 liters per month.
  • Clean rubble and construction waste: 0.5 m³ per year.
  • Vegetable fraction: 1 m³ per year.
  • Bulky waste: 2 m³ per year.
  • Mattresses: 4 units per year.
  • Appliances with CFC: 3 units per year.
  • Fluorescent tubes and mercury waste of domestic origin: 20 units per year.
  • Cosmetics, CDs and DVDs, acids, alkalis, and pesticides: 2 kg per access and 10 kg per year.

Once these thresholds are exceeded, the additional prices include €0.3 per bicycle tire unit, €3 per passenger car tire, €5 per heavy vehicle tire, €50 per ton of clean rubble, €70 per ton of vegetable fraction, €60 per ton of bulky waste, €50 per mattress, and €30 per ton of scrap metal and metals.

Prices for commercial activities

Economic activities and non-domestic users are subject to the payment of the corresponding public prices, in application of the polluter pays principle. A public price per access of €15 (VAT not included) is established for small commercial producers assimilable to domestic ones, an amount that grants the right to deposit up to the maximum limits of the tables.

The recast text also regulates the replacement of selective collection material: identification elements (RFID card or key fob) are provided up to a maximum of two per household per year free of charge, with an additional price of €2 beyond this limit. The replacement of domestic bins ranges from €20 to €85, commercial bins from €20 to €135, and containers between 800 and 1,100 liters is €330.

For acts, festivals, and events, sets of five-fraction bins are invoiced between €630 and €945 per collection, and additional cleaning services per day range between €540 and €900 depending on the time slot and whether it is a weekend.

Entry into force and appeal process

The public price enters into force the day following its publication in the Official Provincial Gazette and remains in effect until its modification or repeal. Against the resolution, which is final and ends the administrative route, a contentious-administrative appeal may be filed before the contentious-administrative Section of the Court of First Instance of Girona within a period of two months from the day following the notification.

The decision directly affects the residents of Girona who use the waste collection center: it clarifies how much waste they can deposit free of charge each year and the amounts by which excess is penalized, and it eliminates the legal uncertainty that the Plenary itself recognized when upholding the appeal of the socialist group.
