Gijón opens public information period for the expropriation in Nuevo Gijón Oeste
Por FactBox Admin

The Local Government Board of the Gijón City Council has agreed to submit for public review the expropriation project for plots 05, 07, and 12 included in the Proposed Planning Area Nuevo Gijón Oeste 05 (APP-NGW-05), due to the failure of their owners to join the Compensation Board. The announcement is published in the Official Gazette of the Principality of Asturias (BOPA) no. 189, dated September 30, 2026, with official reference 2026-07873 and case number 30606N/2025.
The agreement was adopted by the Local Government Board in its session on September 9, 2026, while the announcement is signed by the General Secretariat of the council in Gijón, on September 16, 2026. The processing corresponds to the municipal Administrative Urban Planning Service, within section IV. Local Administration of the gazette.
One month deadline for objections
The project is open to the public for a period of one month, counted from the day following the publication of the announcement in the BOPA. During this period, those who may be interested may submit any observations and claims they deem appropriate.
The announcement specifies that objections may refer, in particular, to two issues:
- The ownership of the rights affected by the expropriation.
- The valuation of those same rights.
Where to consult the documentation
The project documentation will be available throughout the public review period at the following points:
- The municipal urban planning website: https://www.gijon.es/es/directorio/urbanismo.
- The Electronic Access Point installed in the Administrative Building “Antigua Pescadería Municipal”, at Cabrales Street, no. 2.
Objections or observations may be submitted through the electronic registry of the Gijón City Council or, in person, at the municipal registries. The council recommends requesting a prior appointment via telephone 985 18 11 05, the municipal website, or the Gijón application. They will also be accepted at the other offices provided for in article 16.4 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.
Legal framework of the expropriation
The public review is based on article 187 of Legislative Decree 1/2004, of April 22, of the Principality of Asturias, which approves the consolidated text of the legal provisions in force regarding land use and urban planning.
Articles 234 and 269 of the Land Use and Urban Planning Regulations of the Principality of Asturias, approved by Decree 63/2022, of October 21, are also invoked.
The assumption that triggers the procedure is the failure of the owners of the three plots to join the Compensation Board of the area, which enables the expropriation of their assets and rights for the execution of the planning area.
Impact for those affected
The opening of this process opens the last relevant window for the owners of plots 05, 07, and 12 to discuss both the ownership and the price of their land before the expropriation continues its administrative course. Since this is a planning area on urban land in Gijón, what is resolved in this phase directly conditions the economic valuation that the holders will receive and the development schedule of the APP-NGW-05.
