Gelves approves the modification of the statutes of its Compensation Board

The Gelves City Council has initially approved the modification of the Bases and Statutes of the Collaborating Urban Entity “Compensation Board of All Sectors of the PGOU of Gelves”, as set forth in its Consolidated Text. This is stated in the Mayoral resolution no. 1860, dated July 23, 2026, published in the Official Gazette of the Province of Seville number 166, dated August 27, 2026, and signed by the acting mayor Pablo Cordero Herrera.

The entity, with C.I.F. P-4104400-I, is constituted as a collaborating urban entity of public law with its own legal personality, responsible for the management and urbanization of the General Systems of the PGOU of Gelves. Its purpose encompasses the financing and execution of works for the expansion or reinforcement of water supply and sanitation networks, electricity supply, gas, and connection to external general systems, as well as the distribution of burdens among the landowners.

Regulatory framework and scope of action

The new statutes are governed by Royal Legislative Decree 7/2015, of October 30, which approves the Consolidated Text of the Land and Urban Rehabilitation Law; Law 7/2021, of December 1, for the promotion of territorial sustainability in Andalusia (L.I.S.T.A.); Decree 550/2022, of November 29, which approves its General Regulation (R.G.L.I.S.T.A.); and the General Urban Development Plan (PGOU) of Gelves, approved by the Provincial Commission for Territorial Planning and Urbanism of the Province of Seville.

The scope of the Board comprises the five sectors classified as sectorized developable land and the two Execution Units delimited as unconsolidated urban land:

• Sector 1, Sector 2, Sector 3, Sector 4, and Sector 5.
• UE1B and UE2.

Each sector and unit participates in the execution of the General Systems in the proportion determined by the PGOU, with correction coefficients based on the foreseeable consumption demand of the various supplies.

Functions and distribution of burdens

Among the functions of the Board, the following stand out: the integration of owners affected by urban burdens, the request to the City Council for the early transfer of land or the exercise of the power of compulsory expropriation, and the drafting and promotion of the Land Readjustment Project of economic content to distribute the urban burden among the affected lands. The entity also acts as a fiduciary with full disposal power over the properties of its members.

The participation quota of each member is provisionally assigned according to the proportion corresponding to each sector in General Systems and Infrastructure Works, and becomes final once the entity is constituted, and cannot be varied until the approval of the Economic Reparcelling Project. The modification of the statutes and bases requires an agreement of the General Assembly voted by members representing more than 50% of the affected land area, and must be approved by the City Council.

Execution of works and municipal guardianship

Urbanization and infrastructure works shall be contracted by direct award, after comparing at least three offers from construction companies. The Board may demand from the supply companies the reimbursement of the installation costs of the water and electric energy networks, and request from the City Council the use of the enforcement procedure (vía de apremio) for the collection of amounts owed by its members.

The City Council of Gelves acts as the acting Administration and the guardianship and control body, with powers to approve the planning and execution instruments, exercise the power of expropriation, resolve administrative appeals (recursos de alzada), and receive the urbanization works once completed. Until final acceptance, the maintenance of the urbanization shall be the responsibility of the affected owners and the Board itself, which acts as the Maintenance Entity.

The initial approval agreement is subject to a public information period of twenty days, by means of an announcement published in the Official Gazette of the Province of Seville and on the City Council’s Notice Board, as well as on its Transparency Portal. The modification directly affects the owners in the municipality, who may join the entity during this process and are bound by the duties of cession, urbanization, and equidistribution of the burdens imposed by urban planning legislation.
