Garriguella approves the first regulatory ordinance for vehicle gates and entrances

The Garriguella City Council has definitively approved the municipality’s first Regulatory Ordinance for driveways and vehicle entrances, which establishes the conditions for obtaining licenses, fees, signage, and a sanctioning regime. The regulation is published in the Official Gazette of the Province of Girona (no. 165, of August 27, 2026), with the official reference BOP-2026_0_165_7494 and file X2026000193.

The municipal Plenary, in an ordinary session held on June 8, 2026, initially approved the text, which remained open for public inspection for 30 business days in accordance with Article 17 of Royal Legislative Decree 2/2004, of March 5, which approves the Revised Text of the Law regulating Local Treasuries. As no claims were filed, the ordinance has been definitively approved and is reproduced in full in the gazette.

What the new ordinance regulates

The regulation, signed by Mayor Raquel Salas Velasco, is the first to regulate driveways in Garriguella and is based on the regulatory power that Law 7/1985 on the bases of local regime and Royal Legislative Decree 6/2015 on traffic confer upon municipalities. It defines a driveway as a special common use of public domain assets subject to a municipal license, and distinguishes between a driveway, a vehicle entrance, an access curb cut, and a provisional driveway.

The license is granted for a period of 4 years, is discretionary and precarious in nature, and the construction, renovation, or removal of access curb cuts is always at the expense of the holder. The main technical requirements are:

• Minimum width of the driveway or vehicle entrance: 3 meters.
• Licenses are not granted for access gates with a width of less than 2.40 m.
• Licenses are not granted when the height difference relative to the public road is equal to or greater than 10 cm without an access ramp.
• The driveway plate must be placed between 1.5 m and 2.3 m in height, with yellow road markings prohibiting stopping.

Obligations and sanctioning regime

Holders must maintain the pavement and signage, pay the corresponding fee, and carry out at their own expense any maintenance works ordered by the City Council. The ordinance provides for the revocation of licenses due to lack of maintenance, improper use, change of circumstances, or non-payment of the fee, and establishes a sanctioning regime with three levels:

• Minor infractions: fines up to €90.
• Serious infractions: from €90.01 to €300.
• Very serious infractions: from €300.01 to €600.

Very serious infractions expire after 3 years; serious ones after 2 years, and minor ones after 6 months. The competence to initiate sanctioning proceedings and impose sanctions belongs to the mayor, who may delegate this to members of the corporation.

Entry into force and adaptation

The ordinance repeals any other regulation with the same purpose and includes a transitional provision: holders of awnings must adjust their licenses and signage within a maximum period of 3 months from the date of entry into force. The regulation also governs provisional awnings for construction works, with specific signage and limited duration.

With this regulation, Garriguella orders for the first time the use of public space in front of properties and commercial establishments, within a framework that seeks the pacification of streets and sustainable mobility. The regulation affects all owners and businesses in the municipality, who must regularize their situation and comply with the new technical and sanctioning requirements.
