Galicia publishes the new internal regulations of the Transparency Commission

The Official Gazette of Galicia publishes in its issue 152, of 13 August 2026, the Resolution of 31 July 2026 ordering the publication of the new Internal Regulations on the Organization and Functioning of the Transparency Commission of Galicia. The text, approved by unanimity at the ordinary session of 23 June 2026, regulates the independent body that resolves claims regarding access to public information.

The publication responds to the change in attachment brought about by Law 5/2025, of 23 December, on fiscal and administrative measures, which amended Article 33.1 of Law 1/2016, of 18 January, on transparency and good governance. Thus, the body, created by Law 1/2016 and initially attached to the Ombudsman, becomes organically dependent on the Consultative Council of Galicia, the superior advisory body of the Xunta de Galicia and of the regional public administrations, whose independence is recognized by Law 3/2014, of 24 April.

The resolution, signed in Santiago de Compostela by Andrés Lago Louro, president of the Transparency Commission and of the Consultative Council of Galicia, is published as an annex pursuant to Article 45.1 of Law 39/2015, of 1 October, on the common administrative procedure. Article 34 of Law 1/2016 requires the separation of functions between both institutions to preserve the independence of the body, which will have the personnel and material resources of the Council.

An independent body at the service of citizens

The Transparency Commission of Galicia is the independent collegiate body responsible, in accordance with Article 28 of Law 1/2016, for resolving complaints against decisions issued regarding access to public information and against presumed denials of requests. The regulations also assign to it:

• The resolution of complaints concerning decisions of the local entities of Galicia, provided for in Article 24 of Law 19/2013, of 9 December, on transparency, access to public information and good governance.
• To be heard by the Transparency Commissioner before the latter adopts recommendations and issues reports on draft laws and regulations on transparency and good governance.
• To act with full autonomy and independence, with its headquarters in Santiago de Compostela, under the principle of transparency and weighing the public interest and the protection of personal data.

Composition and functions of the Presidency

Chapter II of the regulations develops the composition of the body, provided for in Article 33 of Law 1/2016, and defines the functions of the Presidency, the board members and the Secretariat. The Presidency is responsible for:

• Exercise the representation of the body, convene ordinary and extraordinary sessions and set the agenda.
• Chair the debates, break ties with their vote and sign the minutes and certificates of agreements.
• Sign agreements with public and private entities and resolve requests for access to information addressed to the Commission.

The members are appointed by the Presidency on the proposal of the represented administrations and entities, and the Secretariat corresponds to the legal adviser in the service of the Consultative Council designated by its Plenary.

Meetings, quorum and voting

The Commission shall meet on an ordinary basis once a month, unless the volume of matters advises a different frequency, and on an extraordinary basis when the Presidency so decides or the majority of members so request. Notice of the meeting shall be sent at least five days in advance, together with the proposed resolutions. At first call, the body shall be validly constituted with the presence of the Presidency, the Secretariat and two members; at second call, the presence of the Presidency, the Secretariat and one member shall suffice. Decisions shall be adopted by a simple majority and, in the event of a tie, the Presidency’s vote shall be casting; those voting against must justify their vote within five days.

Publication of resolutions

The resolutions and minutes of the Commission shall be published on its institutional website and on the Transparency and Good Governance Portal, after the dissociation of personal data. The regulations also include special attention to Law 7/2023, of 30 November, for the effective equality of women and men in Galicia in the performance of the body’s functions.

With the new regulations, the framework guaranteeing the right of access to public information in Galicia is consolidated after the transfer of the Commission to the Consultative Council. For citizens, it represents the continuity of an independent body that resolves claims with publicity and separation of functions, reinforcing trust in the defence of their rights against the administrations.
