Galápagos extingue la autorización ambiental de la empresa 3R Ecologic

The Directorate of the Galápagos National Park extinguished the Environmental Administrative Authorization of the company 3R ECOLOGIC GALAPAGOS ECOGPS S.A., granted in 2021 for the project “3R ECOLOGIC GALAPAGOS S.A.” in the archipelago. The measure is contained in Resolution No. MAE-PNG/DIR-2026-0048-RM, signed on September 22, 2026, in Santa Cruz and published in Official Registry No. 385 on Wednesday, October 7, 2026, in the Executive Branch section, page 54.

The administrative act was signed by Mgs. Pablo Augusto Sánchez Hidalgo, Director of the Galápagos National Park and delegate of the Minister of Environment and Energy, in exercise of the powers conferred upon him by Ministerial Agreement No. MAAE-2020-24 of August 31, 2020, which delegated to the DPNG the extinction of environmental permits. His appointment is recorded in Personnel Action No. DPNG-UATH-0563-2026.

The resolution is based on Article 453 of the Regulations to the Organic Environmental Code, according to which the extinction of the environmental administrative authorization proceeds ex officio or at the request of the operator, through a reasoned resolution, once the obligations derived up to the date of the request have been fulfilled. It also invokes Article 508 of the same regulation, regarding the closure and abandonment plan, and Article 103 of the Organic Administrative Code, which regulates the causes for the extinction of an administrative act.

What the resolution orders

  • Article 1: to extinguish the Environmental Administrative Authorization issued via Environmental Registry No. MAAE-SUIA-RA-PNG/DIR-2021-202033 of November 4, 2021, in favor of 3R ECOLOGIC GALAPAGOS ECOGPS S.A., for the project “3R ECOLOGIC GALAPAGOS S.A.”.
  • Article 2: to extinguish the Hazardous and/or Special Waste Generator Registry No. SUIA-10-2021-MAAE-PNG/DIR-RGD-0139 of October 14, 2021, in favor of Mr. JIMENEZ ERMEL RAMIRO.
  • Article 3: to notify Mr. Jiménez Ermel Ramiro, representative of the company, and to publish the resolution in the Official Registry as it is of general interest.

The prior process

The file began with an unnumbered official letter dated July 30, 2026, in which the company representative submitted the project’s Closure and Abandonment Plan Report to the DPNG. Through Official Letter No. MAE-DPNG/DGA-2026-1383-O of August 18, 2026, the Directorate of Environmental Management approved the Closure and Abandonment Plan Compliance Report and announced that it would proceed with the extinction.

Subsequently, Technical Report No. 557-2026-DPNG/DGA-CA dated September 1, 2026, concluded that the project “has no pending obligations regarding its Environmental Permit, approved Environmental Management Plan, nor with the Hazardous and/or Special Waste Generator Registry.” Memorandum No. MAE-DPNG/DGA-2026-0366-M dated September 3, 2026, forwarded the file to the Legal Advisory Directorate, which issued Legal Report No. DPNG-DAJ-081-2026 on September 11, 2026, with a favorable ruling.

Competence and execution

The resolution is further based on Article 258 of the Constitution, which recognizes Galápagos as having a special regime government, and on Articles 3, 20, and 21 of the Organic Law of the Special Regime of the Province of Galápagos (LOREG), which assign the administration and control of the Galápagos National Park and the Galápagos Marine Reserve to the Galápagos National Park Directorate.

  • Certification, distribution, and publication in the Official Registry are the responsibility of the DPNG Administrative Financial Directorate.
  • Publication on the website corresponds to the Directorate of Environmental Education and Social Participation.
  • The execution of the resolution is assumed by the Environmental Management Directorate.
  • The resolution takes effect from its issuance, without prejudice to its publication in the Official Registry.

The extinction formally closes the project’s environmental cycle and releases the operator from the obligations associated with the permit, after verifying compliance with the closure and abandonment plan. The case illustrates how the DPNG, within the framework of the special regime of Galápagos, manages the termination of environmental authorizations in a territory whose conservation is of public interest.
