Por FactBox Admin

The City Council of the Town of Gómara has delegated to the deputy mayor Hilario Molinos Borobio the status of instructing body in the municipality’s sanctioning procedures. The decision was adopted by Mayoral resolution on October 6, 2026, and is published in the Official Gazette of the Province of Soria number 117, corresponding to Friday, October 9, 2026, on page 3455, with the reference BOPSO-117-09102026.
The delegation is approved under Article 44 of the Regulations on the organization, operation, and legal regime of Local Entities, approved by Royal Decree 2568/1986, of November 28, a provision that requires the publication of the delegation of powers of local government bodies for general knowledge. The agreement appears signed in Gómara on October 6, 2026, by the mayor, María García de Vinuesa González.
The publication occurs during a period of continuous administrative activity by the council, which in recent weeks has processed credit modification files and submitted its accounts to the public information procedures provided for in local treasury legislation.
Which competence is delegated
The resolution transfers a strictly procedural function to the deputy mayor’s office: the instruction of sanctioning files, that is, the organization of the actions prior to the resolution that the competent body will issue in due course. The terms of the published agreement are as follows:
- Delegating body: the Mayor’s Office of the City Council of the Town of Gómara.
- Body to which it is delegated: the deputy mayor Hilario Molinos Borobio.
- Delegated competence: acting as the instructing body in sanctioning procedures.
- Date of resolution: October 6, 2026.
- Publication: Official Gazette of the Province of Soria no. 117, of October 9, 2026, page 3455.
Regulatory basis and effects of the agreement
The announcement is inserted in the Local Administration section of the provincial gazette and is disseminated, according to the text itself, “for general knowledge and in compliance with Article 44 of the Regulations on the organization, operation, and legal regime of Local Entities,” approved by Royal Decree 2568/1986, of November 28.
The resolution, which ends the administrative route, exhausts the ordinary appeals in the administrative venue, such that interested parties may only challenge it through the specific channels detailed in the announcement itself.
Deadlines and means of appeal
The published agreement opens two alternatives for challenge, with different deadlines and bodies:
- Optional appeal for reversal (recurso de reposición) before the Mayor of the City Council of Gómara, within a period of one month starting from the day following the publication of the announcement, in accordance with articles 123 and 124 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.
- Contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Soria, within a period of two months from the day following the publication, in accordance with article 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
- If the interested party opts for the optional appeal for reversal, they may not file a contentious-administrative appeal until the former is expressly resolved or is dismissed by administrative silence.
The announcement closes with the usual safeguard formula, reserving any other appeal that the interested party deems appropriate for their rights.
Impact for residents
The delegation directly affects any resident or interested party facing a sanctioning proceeding processed by the City Council of the Town of Gómara: from now on, the instruction of the procedure corresponds to the deputy mayor Hilario Molinos Borobio, while the final resolution will follow the channel determined by the applicable regulations. The publication in the official bulletin is what provides effectiveness and publicity to the agreement and activates the calculation of the challenge periods, thus marking the date from which interested parties can react to the resolution.
