Fustiñana aprueba su ordenanza cívica con multas de hasta 1.500 euros

The Fustiñana City Council has definitively approved the Municipal Ordinance on civic conduct, a regulation that establishes a sanctioning regime of up to 1,500 euros for very serious infractions and which is binding for all persons residing, working, or passing through the municipal district. The text, signed by Mayor Sergio Vitas Aguirre on October 6, 2026, is published in the Official Gazette of Navarra number 213, dated October 26, 2026, under the official reference L2613079.

Definitive approval without objections

The Plenary of the Fustiñana City Council initially approved the ordinance in a session on July 23, 2026. The announcement of the initial approval was published in the Official Gazette of Navarra number 157, dated August 11, 2026, and on the municipal notice board. No objections were submitted during the public information period, therefore the regulation was definitively approved in accordance with Article 325 of Foral Law 6/1990, of July 2, on the Local Administration of Navarra.

The City Council relies on the competencies recognized by Law 57/2003, on measures for the modernization of local government, and by Foral Law 6/1990 itself. The text is structured into five titles: general provisions, promotion of civility, citizen behavior, sanctioning regime, and rehabilitation measures and community services.

Cleanliness, noise, animals, and public space

The articles prohibit causing damage or graffiti to urban furniture and require the repair of damages or the assumption of the cleaning cost. In parks and gardens, it is forbidden to pull up vegetation, light fires, or camp without municipal authorization, and waste must be deposited in the corresponding containers following selective collection rules.

  • Noise: loudspeakers or musical devices at excessive volume, unauthorized pyrotechnics, and construction work outside of daytime hours are prohibited; patron saint festivals and authorized events are excluded.
  • Fumes and emissions: vehicles may not keep the engine running for more than five minutes if they are near dwellings.
  • Animals: it is mandatory to pick up excrement and prevent animals from accessing fountains or human consumption areas; abandonment, mistreatment, and feeding stray animals on public roads are prohibited.
  • Public space: posters or banners may not be placed without authorization, nor may flyers be thrown or vehicles installed for camping purposes without a permit.

Begging carried out in an intimidating or annoying manner is also prohibited, although the text provides that people in need be informed of the available social resources.

Sanctions from 200 to 1,500 euros

The sanctioning regime distinguishes three levels based on the nature of the act, the intent, and the disruption of coexistence or public heritage:

  • Minor infractions: up to 200 euros, such as failing to pick up excrement, littering small waste, or generating mild noise disturbances.
  • Serious infractions: up to 600 euros, such as graffiti, damage to vegetation, urinating in public, letting dogs run loose where leashing is mandatory, or repeated nighttime noise.
  • Very serious infractions: up to 1,500 euros, such as severe damage to public property, repeated serious offenses, or noise of special intensity that severely disrupts neighborhood rest.

In addition to the fine, the obligation to repair damages may be imposed, and owners, organizers, or legal guardians in the case of minors or dependent persons shall be jointly and severally liable. The procedure shall comply with Law 39/2015 on Common Administrative Procedure.

Community service

The ordinance incorporates educational and restorative measures: the City Council may offer, on a voluntary basis, the total or partial substitution of the fine for tasks or services for the benefit of the community, especially for minor and serious infractions or when the offender is a minor. Execution will be supervised by the local police or the competent municipal services.

This regulation repeals all municipal provisions that oppose it and will enter into force once the legal period provided for in the applicable local regulations has elapsed.

The ordinance affects all residents and visitors of Fustiñana, who from now on have a single framework to demand cleanliness, rest, and care for common spaces, and a fixed catalog of sanctions that replaces the previous regulatory dispersion.
