Formentera notifies the completion of sanctions for illegal anchoring of vessels
Por FactBox Admin

The Insular Council of Formentera has issued the presidential resolution ending two sanctioning proceedings for anchoring vessels in unauthorized areas. The notification is published in the Official Gazette of the Balearic Islands (BOIB) no. 127, dated October 8, 2026, under announcement number 10071 on page 54666, and bears the electronic signature of president Óscar Portas Juan dated October 2, 2026. The affected files are 2025/7822EMB and 2025/7804EMB.
The two affected files
- 2025/7822EMB: Emilio García Ibañez Ferrandiz, with a report dated September 22, 2025.
- 2025/7804EMB: Gustavo Adolfo Arnal Muhammad, with a report dated October 7, 2025.
- Infringed precept in both cases: article 35 of the Municipal Ordinance on the use and enjoyment of beaches and bathing areas of Formentera (OMUAP).
- Identification document of the interested parties: partially anonymized in the published announcement.
Failed notification and official publication
The reference regulation is the OMUAP, approved and published in BOIB no. 133, dated October 31, 2017. Since notification by certified letter with acknowledgment of receipt was not possible, the Council has resorted to the publication of announcements under article 44 of Law 39/2015, of October 1, on the common administrative procedure of public administrations.
The complete files remain available to each interested person at the headquarters of the Insular Council of Formentera, Environmental and Coastal Management area, located at Mallorca Street number 15, Sant Ferran, Formentera (Balearic Islands).
Deadline for allegations and means of appeal
Interested parties may submit any allegations they deem appropriate within a period of fifteen days counting from the day after the publication of the announcement. This possibility does not exclude claims or appeals they consider appropriate through other channels.
Background: a series of files opened in 2025
The publication of this October 8 adds to a series of announcements from the same body. In BOIB no. 113, dated September 10, 2026, the Insular Council of Formentera had already notified:
- The initiation of a sanctioning procedure for anchoring in an unauthorized area (announcement 9049, p. 49214).
- Three resolutions ending procedures for the same infraction (announcements 9052, 9053, and 9054, pp. 49215 to 49217).
- One resolution ending a procedure for wild camping (announcement 9055, p. 49218).
On the same October 8, another announcement was published regarding the termination of procedures for anchoring in Formentera, involving three more files: 2025/7819EMB (Yves François mathel Tharin), 2025/8202EMB (Joel Vinson), and 2025/6983EMB (Carlos González Tur).
The notification is of particular interest to boat owners and users of Formentera’s beaches, as it confirms that the Council maintains active control over irregular anchoring on the maritime-terrestrial public domain and that resolutions are made effective via publication when personal notification fails. For those affected, the timeline is decisive: the fifteen-day period for filing allegations begins to count the day after publication in the official bulletin.
