Formentera aprova cedir 2.607 metres quadrats a l'Interior per ampliar la caserna

The Plenary of the Insular Council of Formentera initially approved, in an ordinary session on August 27, 2026, the free transfer of ownership of a plot to the Ministry of the Interior intended for the expansion of the Civil Guard barracks on the island. The agreement, processed under number 10396, is published in the Official Gazette of the Balearic Islands (BOIB) no. 132, of October 17, 2026, in Section V (Announcements, other official announcements), pages 56662 and 56663, and opens a public information period of twenty days.

The transfer will be formalized through an inter-administrative agreement between the Insular Council and the Ministry of the Interior. The competent body to adopt the agreement is the Plenary, in accordance with article 17.1, letter t of the Law of Insular Councils, which grants it the power to authorize the free transfer of real estate to other public or private entities. The announcement bears the electronic signature of the president of the institution, Óscar Portas Juan, dated October 15, 2026.

A plot segregated at Venda des Brolls

The asset subject to the transfer is plot A segregated from registered estate 3735, located at Venda des Brolls, in the parish of Sant Francesc Xavier. Its technical characteristics are:

  • Surface area: 2,607.73 m² (two thousand six hundred and seven meters and seventy-three square decimeters).
  • Boundaries: to the north, cadastral plots 216, 64, 61 and 186 of polygon 7; to the east, cadastral plot 216 of polygon 7 and the remaining estate; to the south, registered estate 3735 from which it is segregated and plots 64 and 186; to the west, plots 64, 61, 186 and 103 of polygon 7.
  • General CRU: 07037000037678.
  • Provisional cadastral reference: 07024A007001300000PX (cadastral plot 130 of polygon 7).
  • Georeference: protocol deed 720/2026 and the segregation licenses contained therein.
  • Registry status: pending registration at the Property Registry of Ibiza no. 4.

Resolutory condition and reversion in five years

The transfer is subject to the resolutory condition that the Ministry of the Interior allocates the plot to the expansion of the Civil Guard barracks. If this purpose is not fulfilled within a period of five years, the transfer will be considered revoked and the plot will revert to the Insular Council, with the effects provided for in the applicable legislation. The clause is based on article 141 of Law 20/2006, of December 15, and article 127.1.a of Decree 127/2005, of December 16.

The Plenary must also approve the final approval of the transfer by an absolute majority. The agreement shall be signed by the president of the Island Council, according to article 21.1, letter k of Law 4/2022, of June 28, on island councils, and shall have a determined duration not exceeding four years, extendable for four more years, in accordance with article 49, letter h of Law 40/2015, of October 1. According to article 113.2 of Law 33/2003, of November 3, it will not be necessary to execute the agreement as a public deed: the certificate of the general secretary with the approval of the Presidency shall be sufficient title for registration in the Property Registry.

Twenty days for allegations and subsequent procedures

The agreement shall be submitted for public information for twenty days, with an announcement in the BOIB and on the electronic headquarters of the Island Council. The term applied is that of article 83 of Law 39/2015, of October 1, as the basic norm and subsequent to Royal Decree 1372/1986, of June 13, which sets only fifteen days. Any allegations or suggestions submitted must be resolved through the corresponding reports.

The file shall incorporate the certification from the Property Registry proving registration in the name of the Island Council, the certification of the general secretary regarding the inclusion of the plot in the Inventory, and the reports from the Secretariat and the Comptroller’s Office, given that it is a plenary agreement requiring an absolute majority according to article 173.1.b of Royal Decree 2568/1986, of November 28, and Royal Decree 128/2018, of March 16. Once formalized, the transfer shall be registered in the General Inventory of Assets and Rights, in the Property Registry, and in the Cadastre, and shall be published on the transparency portal.

Finally, the agreement considers that the tax on the increase in value of urban land is not applicable, as it concerns rural land, in accordance with article 104.2 of Royal Legislative Decree 2/2004, of March 5.

The expansion of the Civil Guard barracks is an action with a direct impact on security and public services in Formentera, an island where the availability of public land is limited. The free transfer allows the Ministry of the Interior to have land to expand facilities that serve the entire population, while the Island Council reserves the reversion of the asset if the purpose is not fulfilled within five years.
