Forced auction of contaminated Tilst tank farm with seven giant fuel tanks

A forced auction of the contaminated tank farm at Borumvej 61 in Tilst will be held on 20 October 2026 at Retten i Aarhus, with the buyer taking over all environmental liability for the site. The auction is announced by the bankruptcy estate of A.A. Service og Tanklager, and the notice was published in Statstidende on 22 September 2026 under reference S18092026-254.

A 41,095 m² plot with seven large fuel tanks

The property comprises matrikel numbers 1v and 5ca, Mundelstrup By, Fårup, with a registered area of 41,095 m², of which 1,530 m² is road. It lies in land zone and is heavily overgrown, with parts fenced in steel and a brick shed with electrical panels in the middle of the plot.

According to the BBR register, the site holds seven underground or above-ground tanks for petrol and heating oil, all listed as in operation:

• Four petrol tanks of 5,000,000 litres each (technical installations 1, 2, 6 and 7)
• Two petrol tanks of 3,750,000 litres each (installations 3 and 4)
• One heating-oil tank of 1,500,000 litres (installation 5)

A 12 m² pump house for energy distribution, built in 1973, is also registered. The building records attached to the sale include a 1967 emergency stock facility for petrol and heating oil, expansions in 1969 and 1985, and a 1996 tank-farm case.

Contamination registered at knowledge level 2

The northern part of the property remains registered as contaminated at knowledge level 2 (V2) under the Danish soil contamination act, following 2009 investigations that found oil contamination. The rules set out in Region Midtjylland’s decision of 15 February 2012 continue to apply to that part of the site.

By decision of 9 January 2024, Region Midtjylland removed the southern part of the property from the register; it had previously been listed at knowledge level 1 because oil had been stored on the site since 1966. Investigations there found no contamination harmful to people or the environment. Both decisions and the underlying reports are attached to the sale particulars.

All environmental risk passes to the buyer

The sale carries a disclaimer of liability that constitutes a special condition under point 11 of Justitsministeriets tvangsauktionsvilkår. The buyer accepts that any investigation, clean-up or remediation obligation relating to the contamination is solely the buyer’s responsibility and risk.

The disclaimer covers all legal and factual matters, including soil, groundwater and other contamination, the extent and boundaries of the plot, the condition of buildings and technical installations, whether the tanks have been lawfully emptied, cleaned or decommissioned, and planning and zoning matters. It applies without any financial or time limit, and the buyer waives any right to rescind the purchase, claim a price reduction or seek damages.

For neighbours, environmental authorities and investors, the notice makes one point clear: the seven tanks and the V2 registration follow the land, not the estate. Whoever bids on 20 October inherits an open-ended clean-up obligation with no recourse against the bankruptcy estate, the curator, the probate court or any mortgagee.
