Fonz approves the 200 euro fee for the use of the municipal wake room

The Fonz City Council has definitively approved the Fiscal Ordinance regulating the fee for the provision of the municipal wake service, which sets the fee for the use of these facilities for a maximum of 48 hours at 200 euros. The regulation, which affects all residents and funeral companies operating in the municipality, is published in the Official Gazette of the Province of Huesca number 157, dated August 19, 2026, with reference BOPH-2026-157006.
The ordinance was initially approved in the plenary session of June 22, 2026, and was definitively approved as no allegations were presented during the public information period. The final text was ratified by the City Council Plenary in an extraordinary session held on June 25, 2026, and will enter into force the day after its publication in the gazette.
Legal Basis and Taxable Event
The fee is based on the powers granted by Article 106 of Law 7/1985, of April 2, regulating the Bases of Local Regime, and Articles 15 to 19 of Royal Decree 2/2004, of March 5, which approves the Recast Text of the Law regulating Local Treasuries.
The taxable event consists of the provision of municipal wake services, for which a request is mandatory when seeking their use. The taxable persons, in the capacity of taxpayers, are the requesting natural and legal persons who use the wake facility.
Fee, Payment, and Duration
The tax quota is set at 200 euros for a maximum provision of 48 hours. Payment must be made at the time of the request, via transfer to any of the bank accounts of the Fonz City Council or by card at the Municipal Offices.
- The maximum ordinary duration is two calendar days (48 hours).
- If more days are needed, it shall be determined by an express Mayoral Resolution, and an additional 100 euros shall be paid.
- No exemption, reduction, or bonus will be granted, except those provided by law or by accredited international treaties.
- If, for reasons not attributable to the applicant, the facilities cannot be used, the fee will be refunded upon request.
Obligations and Sanctions Regime
The use includes the utilization of the facilities for the deposit and wake of a corpse until its transfer to the cemetery, cremation, or the place where the funerals are held. Applicants must respect the facilities, communicate the transfer dates, and take charge of the subsequent cleaning and the transport of the corpse.
Regarding infractions and sanctions, the provisions of Articles 181 and following of the General Tax Law 58/2003, of December 17, shall apply. The persons benefiting from the service shall be liable for any damages caused to the wake facility.
Appeal and Entry into Force
An administrative appeal may be filed against the agreement within two months from the day following its publication, before the High Court of Justice of Aragon. The announcement is signed by the mayor, María Clusa Planisolis, in Fonz, on August 17, 2026.
The new fee represents a significant change for the municipality, as it regulates for the first time the use of a municipal service that until now lacked a specific tax, and directly affects families and funeral homes that manage wakes in Fonz.
