FOGAIBA modifies the 2026 aid for the agricultural diesel surcharge

FOGAIBA has modified the 2026 call for aid intended to compensate for the increase in the price of diesel purchased by agricultural producers due to the war in the Middle East. The resolution, signed by the president of the entity on September 24, 2026, is published in BOIB no. 121, of September 26, 2026, in Section III, under edict number 9592. The changes affect the access requirements and the processing channels, but do not alter the amount of the aid or the deadline for submitting applications.

The regulation now being modified is the Resolution of the president of the Agricultural and Fisheries Guarantee Fund of the Balearic Islands (FOGAIBA) of September 3, 2026, published in BOIB no. 112, of September 8, 2026, which opened the call for the 2026 financial year. This call implements article 15 of Decree-law 1/2026, of April 1, on extraordinary and urgent measures to alleviate the economic crisis derived from the conflict, and is framed within section 2.1 of the Temporary Framework for aid responses to the crisis in the Near East (C/2026/2593), approved by the Commission on April 29, 2026, and published in the OJEU on May 5, 2026.

The regional regime is concurrent with the state aid of article 46 of Royal decree-law 7/2026, of March 20, which sets 0.20 euros per liter. FOGAIBA has notified its regime to the European Commission, which has assigned it number SA. 124823 (2026/N), and the effectiveness of the call is conditional upon a favorable decision declaring its compatibility with the internal market.

New requirements to access the aid

The modification rewrites the alternative specific requirement of the third section of the call and splits it into two scenarios, both referring to aid with intervention code 6613:

• Letter b.2) is limited to the 2025 calls: the compensatory payment for mountain areas and for areas with specific limitations, called by the Resolution of the president of FOGAIBA of January 28, 2025 (BOIB no. 14, of January 30, 2025).
• The new letter b.3) incorporates the 2026 calls, called by the Resolution of the president of FOGAIBA of January 23, 2026 (BOIB no. 15, of January 31, 2026), and it is sufficient to have been declared a beneficiary in the proposed resolution for granting, provided that the final resolution is issued under the same terms.

The reason is that the final determination of the beneficiaries of the 2026 compensatory payments will not occur when the application deadline ends, the moment at which the call required the requirement to be met. The verification of these points is carried out ex officio by FOGAIBA, unless there is express opposition from the interested person.

Applications also via non-electronic channels

The resolution also makes the processing more flexible. The initial call required all interested parties to interact electronically with FOGAIBA, as the potential beneficiaries coincided with the recipients of state aid. Since the group of recipients for the regional aid is broader, the possibility is opened for natural persons to submit the application and carry out the remaining procedures through means that are not necessarily electronic.

However, the obligation to use electronic means is maintained for those already required to do so by Article 14.2 of Law 39/2015, of October 1, and for those who voluntarily opt for this route. Applications may be addressed to the Agricultural and Fisheries Guarantee Fund of the Balearic Islands (A04026954) and submitted to the entry registries of FOGAIBA, the Department of Agriculture, Fisheries and Natural Environment, or any of the registries provided for by administrative regulations. Communications and notifications of the procedure will be made by electronic means.

Figures and deadlines that do not change

The modification does not affect the economic elements of the call:

• Total maximum amount: 750,000.00 euros, charged to the 2026 FOGAIBA budgets and 100% financed by the Autonomous Community of the Balearic Islands.
• Amount of aid: 0.10 euros per liter of agricultural diesel purchased.
• Eligible period: from March 1 to June 30, 2026.
• Application deadline: from the day after the publication of the call until October 2, 2026.

According to the report from the Agricultural Reform and Development Service of September 2, 2026, taking the historical price of 0.844 euros per liter as a reference, the maximum eligible amount is 0.301 euros per liter. With an estimated additional cost of 0.45 euros per liter, the state aid covers 44.44% and the regional aid an additional 22.22%, placing the cumulative intensity at 66.66%, below the 70% limit of the Temporary Framework C/2026/2593.

The resolution must be communicated to the National Grants Database and published in the Official Gazette of the Balearic Islands. The text specifies that the changes are procedural in nature and do not alter the criteria to be assessed by the European Commission, for which reason notification is not considered necessary.

For the primary sector of the Islands, the modification de facto widens the gateway to the aid: producers who remain as beneficiaries of the 2026 compensatory payments will no longer lose the right to request diesel compensation, and natural persons gain a route for in-person processing. With the deadline open until October 2, the window for submitting applications is only a few days.
