Faloca appeals to the TSJC regarding the La Palma volcano aid

The Vice-Ministry of Economic and Social Recovery of La Palma has submitted to the High Court of Justice of the Canary Islands the administrative file of the appeal filed by Faloca, S.L. against Order No. 126/2025, of May 28, which granted direct aid to compensate for the economic damages caused by the volcanic eruption on the island. The decision was formalized through the Resolution of July 30, 2026, and is published in the Official Gazette of the Canary Islands No. 194, of September 28, 2026, in section V of announcements. The litigation is being processed as ordinary procedure No. 237/2026 before the Administrative Litigation Chamber, Second Section, based in Santa Cruz de Tenerife.

Nine days to appear

The second section of the resolution summons all those who appear as interested parties in the administrative litigation appeal to appear and present themselves before the Chamber. The summons is addressed to all those who can prove a legitimate interest in the proceedings, not only to the parties initially appearing, so that they may defend their position before the Chamber rules on the contested Order.

Background of the compensations

Order No. 126/2025 is part of the block of measures approved by the Government of the Canary Islands to compensate for the damages caused by the volcanic eruption in La Palma. In the same vein, the Official Gazette of the Canary Islands has been publishing resolutions granting aid to those affected, such as those from the Canarian Housing Institute dated August 24, 2026, regarding emergency aid for the rental of primary residences corresponding to the fifth four-month period, disseminated in the Official Gazette of the Canary Islands No. 178, dated September 4, 2026.

The resolution now published does not anticipate the sense of the judgment nor does it evaluate the arguments of Faloca, S.L.: it is limited to complying with the procedure of forwarding the file and opening the period for appearance.

Impact

This is the first relevant litigation regarding compensations for those affected by the eruption to reach the Contentious-Administrative Chamber of the High Court of Justice of the Canary Islands via the Official Gazette of the Canary Islands. The outcome of ordinary proceeding No. 237/2026 may condition the interpretation of the criteria for granting direct aid and, consequently, the position of other natural persons and entities that have requested or received compensation for the volcano damages.
