Fageca suspends for two years the licenses of tourist homes

The Plenary of the Fageca City Council, in a session held on 7 August 2026, approved initiating the processing of the Tourism Resources Management Plan (PORT) and agreed, on a precautionary basis and linked to its drafting, to suspend the granting of urban compatibility certificates, urban planning licenses and responsible declarations for new tourist-use dwellings throughout the entire municipal area. The announcement is published in the Official Bulletin of the Province of Alicante, number 152, of 13 August 2026 (notice 6242/2026), in Section III, Local Administration.
The agreement is adopted under Article 27 and the second additional provision of Law 15/2018, on tourism, leisure and hospitality of the Valencian Community. The PORT, with the nature of an ordinance, will zone the implementation of tourist-use dwellings, determine the compatibility or incompatibility of the use by zones and may set the maximum number of dwellings under Article 64 bis of said law, with criteria that the bulletin describes as clear, unequivocal and objective.
Fageca, a rural municipality in the Comtat region with barely one hundred inhabitants according to the INE (2025) and an area of 10.17 square kilometers, thus joins the city councils that are trying to contain the growth of tourist accommodation in dwellings.
A precautionary moratorium of up to two years
The suspension affects urban compatibility certificates, urban planning licenses and the acceptance of responsible declarations aimed at the implementation of new tourist-use dwellings, including the conversion of existing dwellings to that use, throughout the entire municipal area.
The measure takes effect from the date of adoption of the plenary agreement and is governed by Article 68 of the TRLOTUP, with the following terms:
- maximum duration of two years;
- lifting of the suspension if, after one year, the instrument has not been submitted to public exhibition.
Applications in progress and comment period
Applications for compatibility certificates, responsible declarations or licenses already on file with the City Council will be processed and resolved in accordance with Article 21 of Law 39/2015, on the common administrative procedure of public administrations.
The file is placed on public information for a period of thirty business days, counted from the day following the insertion of the announcement in the Official Gazette of the Valencian Government, so that interested parties may submit objections, suggestions or claims. The documentation is available at the municipal offices and on the Transparency Portal, accessible from the City Council’s electronic headquarters (facheca.sedelectronica.es). The announcement appears signed by the mayor, Ismael Vidal Soneira.
A pause to regulate tourist accommodation
With this moratorium, Fageca freezes for up to two years the opening of new tourist accommodations while the plan is drafted that will establish, by zone, where and how many tourist-use dwellings may operate. The measure directly affects owners and investors who had planned to dedicate properties to holiday rentals, including the conversion of existing homes, and conditions the future of the tourism offer in a micro-municipality in the Alicante hinterland where this type of activity has been gaining weight.
