Urgent expropriations on the EN 243 in Porto de Mós declared of public utility

The Government has declared the public utility, with urgent character, of the expropriations of real estate and inherent rights necessary for the execution of the road platform restoration work of the EN 243, in the sections of km 8+560, km 9+100 and km 9+200. The decision is contained in Order no. 10465/2026, signed on August 3, 2026, by the Secretary of State for Infrastructure, Hugo Morato Alface do Espírito Santo, and published in the Diário da República, 2nd series, no. 163, of August 24, 2026.

The EN 243 is managed by Infraestruturas de Portugal, S. A. (IP), which requested the declaration following a resolution of its executive board on July 2, 2026. The work falls within the object and scope of the General Concession Contract of the National Road Network, entered into with the State and approved by Council of Ministers Resolution no. 174-A/2007, of November 23, the bases of which were approved by Decree-Law no. 380/2007, of November 13.

Legal Framework

The declaration is based on the Expropriation Code, specifically paragraph a) of no. 1 of article 14, nos. 1 and 2 of article 15, and no. 1 of article 19, in its current wording, as well as the Statute of the Roads of the National Road Network, approved by Law no. 34/2015, of April 27. The Secretary of State acted using the competence delegated by Order no. 12445/2025, of October 15, of the Minister of Infrastructure and Housing.

IP is the managing entity of the national railway and road infrastructures, under the terms of Decree-Law no. 91/2015, of May 29, holding the powers relating to the expropriation and occupation processes provided for in the Expropriation Code.

Affected Plots and Owners

The work is located in the district of Leiria, municipality of Porto de Mós, and covers plots identified in the area map and plot plans published as an annex to the order. Among the affected owners are:

• Manuel Vala Pragosa and wife Maria Isilda Marques Muliano, parish of S. João Baptista, Porto de Mós;
• Helena da Assunção Mateus Frazão, parish of Alvados e Alcaria;
• Joaquim Augusto Cordeiro de Almeida and others, and José Pinheiro Calado and another;
• Conceição Vicente Pinheiro Cavaleiro, Cidalina Vicente Carreira Monteiro and other holders of the plots in question.

Administrative Possession and Charges

The order authorizes Infraestruturas de Portugal, S. A. to take administrative possession of the plots, given the urgent nature of the expropriation, considering the public interest underlying the swift and effective execution of the projected work, in order to better serve the citizens for whom this public investment is intended.

The costs associated with the expropriations are borne by the IP, which has financial coverage under the budget line D.07.01.13.B0.B0, and these are duly recorded in a specific line of the Activities Plan and Budget.

The declaration of urgency allows for the acceleration of the restoration of the road platform of the EN 243, a road managed by the IP whose maintenance in good working order and safety is the obligation of the concessionaire. For the owners and for local mobility in the municipality of Porto de Mós, the measure anticipates the road intervention, with a direct impact on traffic and the enhancement of the territory served by this national road.
