The Director of Labor and Social Security of the Basque Government has announced that a fine of 49,181 euros has been imposed on the company Oca Instituto de Certificación Sociedad Limitada, as published in number 191 of the Official Gazette of the Basque Country on October 6, 2026. The penalty is due to a very serious infringement in the field of occupational risk prevention and became final on June 26, 2026. The publication was ordered by a resolution dated September 16, 2026, with official reference 2026/4125, and is included in the “Other provisions” section of the gazette.

According to the background of the resolution, the penalty was imposed on July 23, 2024, by the then Director of Labor and Social Security, in file 48/2024/184 and as a result of infringement act I482024000046036. The infringement is based on article 13.12 of the Single Text of the Law on Infringements and Sanctions in Social Matters, approved by Royal Decree-Law 5/2000 of August 4.

That article considers it a very serious infringement for specialized entities acting as prevention services or those auditing a company’s prevention system to have commercial, financial, or other links with the audited or contracted companies that are not related to their activity. The provisions also expressly prohibit entities that provide or certify prevention training from certifying activities that have not been carried out at all.

Penalty and sanctioned company

The resolution orders the publication of the following data:

  • Company: Oca Instituto de Certificación Sociedad Limitada.
  • Sector of activity: technical testing and analysis.
  • Tax Identification Number: B65341075.
  • Registered office: Vía de las dos Castillas (Oca Group building) 7, 28224 Pozuelo de Alarcón (Madrid).
  • Amount of the penalty: 49,181 euros.

Timeline of proceedings

The resolution includes the full chain of dates, from the 2024 act to the 2026 publication:

  • Date of the infringement act: May 23, 2024.
  • Date of the penalty resolution: July 23, 2024.
  • Finality: June 26, 2026.
  • Resolution ordering publication: September 16, 2026.
  • Publication: October 6, 2026, number 191.

Registry and data validity

The second part of the resolution orders the penalty data to be inscribed in the registry of sanctions for very serious infringements in the field of occupational risk prevention. The registry is attached to the Directorate of Labor and Social Security.

The registry data will be deleted after five years, counted from the day following the publication of the penalty in the official gazette. Therefore, the publication will have practical consequences until at least 2031.

Competence lies with the Director of Labor and Social Security, according to the organic structure established by Decree 323/2024 of November 5, as well as according to the provisions of Royal Decree 928/1998 of May 14 and Decree 244/2012 of November 21. The latter regulates the publication of very serious infringements and the sanction registry for companies, and was published in the official gazette of December 4, 2012.

The resolution was signed in Vitoria-Gasteiz by María Victoria Portugal Llorente, Director of Labor and Social Security, on September 16, 2026.

The publication of the sanction has an impact on the certification and prevention services sector, as it calls into question the independence of the providers that companies use to verify audits and training. The case demonstrates that the prohibition of commercial ties is not merely formal: classified as a very serious infringement, the penalty is a fundamental condition of the company’s activity and will remain visible in the registry for five years.
