Euskal Trenbide Sareak Forua-Kortezubi tartean deslinde administratiboa abiatu du

The public entity Euskal Trenbide Sarea-Red Ferroviaria Vasca has approved the resolution to begin the administrative demarcation of the Forua-Kortezubi section of the Amorebieta-Bermeo railway branch. The decision was signed by Director General Antonio López Palenzuela on September 24, 2026, and published in the Official Gazette of the Basque Country (BOPV) in issue number 192, on October 7, 2026, with official reference 2026/4147. The resolution also includes a list of affected owners, with a call to carry out the field work for the demarcation from December 9 to 11.

The purpose of the demarcation is to define the physical and legal boundaries of the Amorebieta-Bermeo branch of the Bilbao-Donostia railway line, between the public domain assets located in the Historical Territory of Bizkaia and the adjacent properties. The entity has verified that in several sections the boundaries are imprecise and there are disputes with neighboring estates, and therefore has decided to carry out the demarcation in sections, processed in homogeneous intervals.

The legal basis consists of Legislative Decree 2/2007 (of November 6, Law of Basque Heritage), articles 19.1.b) and 24, and Decree 143/2023 (of October 3), articles 15 and 17; Law 39/2015 applies supplementarily. Competence lies with the Director General, according to the decision taken by the Administrative Council in the meeting of March 30, 2026, under the protection of articles 9.1 and 10 of Law 6/2004.

Field work from December 9 to 11

The field work for the demarcation will be carried out in the Municipality of Forua, over three days:

  • December 9, from 9:30 AM to 1:00 PM.
  • December 10, from 9:30 AM to 12:45 PM.
  • December 11, from 9:30 AM to 12:00 PM.

As specified in the resolution, the call fulfills the minimum interval of two months between the publication and the field work, as required by article 17.6 of Decree 143/2023.

Allegations and consultation of the file

Interested parties may submit allegations and provide documents up to twenty days before the date of the demarcation. Writings must be addressed to the Legal Advisory Area at the Bilbao offices of the Euskal Trenbide Sarea-Red Ferroviaria Vasca entity (San Vicente street 8, Albia I building, 14th floor, 48001) or via the electronic registry.

The file may also be consulted at those offices, by requesting a prior appointment at 94 657 26 00, referring to this resolution.

Affected owners and entities

The annex to the resolution contains the list of owners of the adjacent estates, including the estate number, cadastral reference, and summons time. A total of nearly one hundred estates are listed: 96 in the municipality of Forua and 2 in Kortezubiko. Among the private owners, among others, appear Jose Luis Izaguirre Landa, Asier Agirre Boenetxea, Ramon Aguirre Boenechea, Maria Jesus Calabuig Mazarredo, Jeronimo Argatxa Martiartu, Juliana Beitia Basabe, Jose Antonio Torrealday Llona, and the successors of Mercedes de Mazarredo Iriarter.

The following public entities also appear:

  • Forua City Council and Gernika-Lumo City Council.
  • Heritage Service of the Provincial Council of Bizkaia.
  • Basque Water Agency (Ura).
  • Coastal Demarcation of the Basque Country.

The resolution will be notified to these owners, to the Directorate of Transport Infrastructures of the Department of Sustainable Mobility, and to the municipalities that the section crosses. Publication will be made in the BOPV, the Official Gazette of Bizkaia (BOB), on the municipal notice boards, and on the entity’s electronic headquarters.

Conclusions

The resolution does not exhaust the administrative route and is not subject to appeal in its own right, without prejudice to those that may be filed against the resolution that concludes the procedure. Regarding the Property Registry, no marginal note will be requested, as there are no registry data to identify the estates; however, the resolution approving the demarcation will be sufficient for entry into the registry and for correcting the inscriptions.

This demarcation will help establish the legal arrangement of the Amorebieta-Bermeo branch, and it has a direct precedent in the Murueta-Busturia-Sukarrieta section: the procedure there began with the resolution of August 10, 2026, was published in issue no. 171 of the BOPV on September 8, 2026, and the field work will take place from November 10 to 13.
