Por FactBox Admin

The Estepa City Council has initiated the expropriation proceedings for the private plots affected by the project to improve the municipality’s high-pressure drinking water supply network. The agreement was adopted by the Corporation’s Plenary in an ordinary session on September 29, 2026, and is published as a Local Administration announcement in the Official Gazette of the Province of Seville No. 203, of October 20, 2026 (reference BOP-SE-2026-203014), with the electronic signature of the Mayor-President, Antonio Jesús Muñoz Quirós, on October 16.
A single proceeding with three types of impact
The plenary agreement, supported by Article 17.2 of the Compulsory Expropriation Law (LEF) and Article 122.1 of the LISTA, declares the public utility and social interest for urban planning reasons of the actions contemplated in the “Project for the improvement of the high-pressure drinking water supply network, from the intake to the general reservoir, Estepa (Seville)”, processed by the Provincial Council of Seville under file number PEAS/125/2024 and integrated into municipal file 1618/2026.
The corporation initiates a single and joint proceeding that encompasses three figures:
- Expropriation of full ownership of the land.
- Establishment of permanent aqueduct and power line easements.
- Temporary occupation of land during the works.
Technical Report No. 006/25 is accepted as the quantitative and qualitative basis for the list of assets and rights, assimilated into the municipal appraisal sheets for the proposed settlement with the owners.
Ten cadastral references from polygon 2
The published impact table details ten plots in polygon 2 of the municipality of Estepa, with cadastral areas ranging from 0.20 to 165.74 hectares. The largest easement impacts correspond to plots 135 (6,215.40 m²), 272 (5,013.07 m²), and 140 (3,731.79 m²); the expropriation of full ownership is concentrated in plots 272 (78.46 m²), 140 (64.00 m²), 135 (48.00 m²), and 137 (16.00 m²). Altogether, the announcement records more than 20,400 m² of easement and 12,062 m² of temporary occupation.
The third point of the agreement expressly cites plots 272, 460, 139, 273, 225, 16, 141, and 17, while the impact table and the list of holders in the same announcement detail ten cadastral references, including plots 135, 137, 138, 140, and 248.
Affected owners and proceedings underway
The individualized list of owners and assets includes the following holders, with their cadastral references and addresses for notification purposes:
- María Teresa Luque Moyano (plot 135) and Antonio Rafael Luque Moyano (plot 137), both residing in Seville.
- Francisco Marrón González (plot 140).
- Margarita de la Cruz Fernández (plot 272).
- José María Pérez Fernández (plots 460, 248, and 265).
- Heirs of Villalba Blanco Francisco (plot 138).
- Patricio Domínguez Jiménez (plot 139).
- Heirs of Fernández Guerrero Antonio (plots 273 and 225).
- José Fernández Reina and Luisa Fernández Reina (plot 16).
In parallel, the City Council will request authorizations and reports from the Ministry of Sustainability, Environment and Blue Economy (livestock routes and watercourses), the Provincial Council of Seville (roads), and the distribution and marketing companies regarding the impact on the gas pipeline.
Fifteen days to appeal and twenty to resolve
The announcement opens a public information period of fifteen days from its insertion in the BOP of Seville, during which the file may be examined at the municipal Urban Planning Department and allegations, data, or error rectifications may be submitted. The publication will be completed with a newspaper of wider provincial circulation and with individual notification to each affected party, in accordance with Article 18 of the LEF.
In light of the allegations, the Plenary will resolve within twenty days regarding the need for occupation, definitively approving the list of assets and rights and nominally designating the interested parties. That agreement will open the separate fair price valuation process, in accordance with Articles 24 et seq. of the LEF, 122 and 123 of the LISTA, and 267 of its Regulations.
The decision directly affects the assets of a dozen private owners in Estepa and conditions the schedule of a drinking water infrastructure that runs from the intake to the municipality’s general reservoir. The owners have a brief window to negotiate expropriation agreements or submit allegations before the Plenary definitively fixes the occupation of their land.
