Energia shuts down the Pilotes Solar photovoltaic park in Felanitx due to fire risk

The Ministry of Enterprise, Freelancers and Energy has accepted the developer’s request to withdraw and has denied the application for prior administrative authorization, recognition of public utility for the purposes of the declaration of general interest, and ordinary environmental impact assessment for the photovoltaic installation PFV Pilotes Solar and its evacuation line, located in polygon 31, plots 1188 and 1191, in the municipality of Felanitx. The decision is published in the Official Gazette of the Balearic Islands (BOIB) no. 118, of September 22, 2026, Section III, p. 51285, under resolution number 9438. The developer, Morales Green Renovables, SLU, had requested the withdrawal on May 25, 2026.

The resolution bears the electronic signature of September 17, 2026, and was issued by the Director General of Circular Economy, Energy Transition and Climate Change, Diego Viu Domínguez, by delegation of the Minister of Enterprise, Freelancers and Energy (BOIB no. 97, of 07/24/2025). The file number is RE017/25 and the promoting company has the NIF B72518467.

A 2022 project halted by the municipal report

The procedure began on June 26, 2022, when Morales Green Renovables, SLU requested prior administrative authorization for the photovoltaic installation and the evacuation line in polygon 31 of Felanitx. On July 4, 2025, the Director General of Circular Economy, Energy Transition and Climate Change issued a resolution regarding this same authorization.

On May 25, 2026, the entity requested the withdrawal due to the technical report from the Felanitx City Council, file number 218/2026, regarding the viability of the photovoltaic implementation of the park on plots 1188 and 1191 of polygon 31. The technicians of the Directorate General of Circular Economy, Energy Transition and Climate Change examined the documentation and reported unfavorably on the project, without conducting a technical evaluation, precisely in accordance with this municipal report.

High fire risk zone and rural land

The report from the Felanitx City Council concludes that the lands where the plant is intended to be installed are affected by a high forest fire risk zone (ZAR) according to Decree 22/2015, of April 17 (BOIB 56/2015), which approves the IV General Plan for Defense Against Forest Fires of the Balearic Islands.

According to the same report, the project fails to comply with the provisions of article 36.2.5 of Decree 33/2015, of May 15, on the definitive approval of the modification of the Sectoral Energy Master Plan of the Balearic Islands. This regulation requires that installations be located in degraded spaces, on land with low agricultural productivity, or effectively integrated into agricultural activity, in accordance with current agricultural legislation.

Archiving of the file and deadlines for appeal

The operative part of resolution 9438 establishes three points:

• To consider the promoter’s petition as withdrawn and deny the request for prior administrative authorization, recognition of public utility, and ordinary environmental impact assessment of the park and the evacuation line.
• To declare the procedure concluded and archive the file.
• To notify the interested party of the resolution and publish it in the BOIB.

The legal grounds invoked include Law 2/2020, of October 15; Royal Decree-Law 23/2020, of June 23; Law 10/2019, of February 22, on climate change and energy transition; Law 24/2013, of December 26, of the electricity sector; Law 3/2019, of January 31, agrarian law of the Balearic Islands; Law 21/2013, of December 9, on environmental assessment; Legislative Decree 1/2020, of August 28; Decree 10/2025, of July 14, and Royal Decree 997/2025, of November 5.

Against the resolution, which exhausts the administrative route, an optional appeal for reversal (recurso de reposición) may be filed before the Minister of Business, Self-Employed and Energy within a period of one month from the day following publication. Alternatively, a contentious-administrative appeal may be filed directly before the Contentious Chamber of the High Court of Justice of the Balearic Islands within a period of two months.

The decision closes a file opened more than four years ago and reinforces the municipal criterion regarding the implementation of photovoltaic parks on rural land affected by fire risk, one of the most recurring points of friction between energy promoters and city councils in Mallorca.
