Energy revokes three ERDF photovoltaic grants due to lack of justification
Por FactBox Admin

The Minister of Enterprise, Self-Employment and Energy has revoked three grants for the promotion of solar photovoltaic and micro-wind energy installations under the ERDF Program 2021-2027 (FOTOPAR 2026) and has declared the corresponding files closed and archived. The decision is published in the Official Gazette of the Balearic Islands (BOIB) no. 137, of October 27, 2026, under reference 10729, and nullifies 8,592 euros in public aid. The resolution is dated October 26 and is signed, by delegation of the minister, by the Director General of Circular Economy, Energy Transition and Climate Change, Diego Viu Domínguez.
The parent call is the Resolution of the Minister of Enterprise, Self-Employment and Energy of December 19, 2025 (BOIB no. 171, of December 25, 2025), which approved the 2026 grants aimed at individuals and homeowners’ associations via the advance expenditure route. The credit was later expanded by the Resolution of May 28, 2026 (BOIB no. 69, of June 2, 2026). The procedure is processed in accordance with Law 38/2003, of November 17, General Subsidies Law, Royal Decree 887/2006, of July 21, Legislative Decree 2/2005, of December 25, and Decree 75/2004, of August 27.
The revocation closes a procedure initiated with the provisional resolution proposal of the Director General of October 5, 2026, published in BOIB no. 127, of October 8, 2026, which opened a period of ten business days to present allegations. According to the now-published resolution, this period has expired without any being presented, and the expenditure is annulled against budget items 2025/G/731A01/78000/00/19701/31111 and 2026/G/731A01/78000/00/19701/FI026.
The three affected files
The annex of the resolution, titled “List of beneficiaries whose grant is revoked for failure to justify,” details the cases:
- MIGUEL ANGEL BORRAS ABRINAS, file FOTOPAR26-626/2026, 3,000.00 euros, item 2026/G/731A01/78000/00/19701/FI026.
- ARANTXA VAN DER ELST CASTELLS, file FOTOPAR26-908/2026, 2,592.00 euros, item 2026/G/731A01/78000/00/19701/31111.
- WILHELM HUMBERTUS EKROD, file FOTOPAR26-907/2026, 3,000.00 euros, item 2026/G/731A01/78000/00/19701/31111.
The three amounts total 8,592.00 euros. In all cases, the resolution orders the authorization and negative disposal of the expenditure in favor of the beneficiaries, the declaration of the procedure as concluded, and the archiving of the files.
An accepted allegation removed from the list
The resolution expressly excludes a fourth file that did appear in the provisional proposal. This is FOTOPAR26-783/2026, held by Antonia Fornaris Ramis, with a grant of 7,300.80 euros, which had been included because the action was carried out at a location different from the one specified in the application.
The beneficiary submitted an appeal on October 8, 2026, and the technicians from the Directorate General for Circular Economy, Energy Transition and Climate Change reported favorably, so the file is removed from the annex and the grant is not lost.
Actions outside the eligible period
The reasons appear in the annex of the provisional proposal of BOIB no. 127. In the three cases, the Directorate General concluded that the actions did not comply with the period required by section 4.7 of the call:
- In file FOTOPAR26-626/2026, it was verified that actions had been carried out during 2025, before the period specified in the call.
- In file FOTOPAR26-908/2026, the installation had been registered and invoiced between February 13, 2025, and October 31, 2025, also prior to the eligible period.
- In file FOTOPAR26-907/2026, the payments for the photovoltaic installation had occurred before the submission of the application.
Simultaneous waivers and previous revocations
The same BOIB no. 137 contains another resolution from the Department, with reference 10684, which accepts the waiver of four beneficiaries of FOTOPAR 2026 grants and revokes the award: Moises Borras Tejedor (2,448.00 euros), Katia Borras Tejedor (984.00 euros), Michael Guenter Kloft (15,600.00 euros), and Francisco Guerrero Castellanos (7,200.00 euros), totaling 26,232.00 euros.
Revocation due to lack of justification had already been applied previously in this call: in BOIB no. 106, of August 25, 2026, with a file of 3,000.00 euros, and in BOIB no. 130, of October 13, 2026, with a file of 4,260.00 euros.
Against the resolution, which exhausts the administrative route, an optional appeal for reversal may be filed before the Minister of Enterprise, Freelancers and Energy within one month from the day after publication, or a contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of the Balearic Islands within two months.
For those who had requested the grant, the publication means definitively losing a subsidy that had already been granted and which, in some cases, covered a large part of the installation cost. The resolution makes it clear, however, that the control of the justification is strict: the execution date, invoicing, payment, and location of the installation are verified one by one, and any discrepancy with the call cancels the grant.
