Dismissed allegations and corrected owners
The file was subject to public consultation for thirty days through announcements in the Official State Gazette (Boletín Oficial del Estado) no. 310, of December 28, 2023; the Official Gazette of the Province of Las Palmas (Boletín Oficial de la Provincia de Las Palmas) no. 157, of December 29, 2023; the Official Gazette of the Canary Islands (Boletín Oficial de Canarias) no. 5, of January 8, 2024; the newspaper Canarias7, of January 12, 2024; the notice board of the City Council of San Bartolomé de Tirajana and the regional electronic headquarters. Allegations were submitted by Elmasa Tecnologías del Agua, S.A.U. and Invercasti Alfa, S.L.; by the heirs of Alejandro del Castillo Bravo de Laguna and Propiedades Mejoradas, S.L.; by Pedro Fernando del Castillo Bravo de Laguna, Elmasa Patrimonial, S.A., Inversiones San Felipe, S.L. and Inversiones Santa Águeda, S.L.; by Grupo Inmobiliario Tinojai, S.L., Grupo Tinojai, S.L. and Santa Águeda Sun Golf, S.L., and by Hijos de Francisco López Sánchez, S.A., in addition to a joint reiteration registered on March 15, 2024.
The resolution grants only the rectifications of ownership and surface areas and dismisses the opposition to the public utility, the easements, and the requests to underground the overhead layout, as it is an installation included in the binding electrical planning. The City Council of San Bartolomé de Tirajana reported favorably on the overhead layout regarding the PGOU'96, but unfavorably on the underground layout due to its impact on the urban and tourist road network.
Urban and Environmental Fit
The line appears in the Electric Energy Transmission Network Development Plan 2021-2026, approved by Agreement of the Council of Ministers on March 22, 2022. The Government Council of the Canary Islands approved Decree 143/2026, of September 4, which agrees to the execution of the project and orders the modification of the affected planning; previously, Order no. 221/2026, of June 11, 2026, from the Counselor of Ecological Transition and Energy, declared the general interest of the works. The Environmental Impact Report, formulated by Resolution no. 232/2026, of April 1, 2026, from the General Directorate of Environmental Quality, concludes that there will be no significant effects provided that the measures in the annex are met, including the protection of birdlife with bird diverters and the archaeological control of the works.
Expropriation and Deadlines
The declaration of public utility implies the need for occupation and urgent occupation for the purposes of Article 52 of the Compulsory Expropriation Law of December 16, 1954. The annex of the resolution lists the affected plots, up to fifty, with owners such as Red Eléctrica de España, S.A.U., Grupo Inmobiliario Tinojai, S.L., the hereditary community of Alejandro del Castillo Bravo de Laguna, Hijos de Francisco López Sánchez, S.A., Acadeo, S.L., Garbor Modas, S.L., Gompromanda 2000, S.L., Promociones Olirola, S.L., the City Council of San Bartolomé de Tirajana, and the Insular Council of Gran Canaria. The promoter must request the commissioning within a maximum period of 24 months from notification. An administrative appeal (recurso de alzada) may be filed against the resolution, which does not exhaust administrative remedies, within a period of one month.
The authorization clears the final administrative obstacle for an infrastructure with which the Canarian Executive plans to reinforce the transport network of southern Gran Canaria and improve the reliability of the electricity supply in the tourist area of San Bartolomé de Tirajana. For the owners included in the annex, the next step is the expropriation procedure, where the impacts and compensations will be specified, with the possibility of mutual agreement settlements.
