Energy extends deadlines for electrical migration of self-supply and cogeneration

The Ministry of Energy published in the Official Gazette of the Federation (number 244/2026, Tuesday, September 8, 2026) the Agreement modifying, eliminating, and adding various provisions to the Guidelines for the voluntary and expedited migration of self-supply and cogeneration of electric energy to the figures provided for in the Electric Sector Law. The measure, signed by Secretary Luz Elena González Escobar on August 31, 2026, extends the dates and deadlines of the Migration Procedure calendars to allow more time for the corporate and contractual arrangements of sector participants.

The agreement enters into force on the business day following its publication and reforms articles 5, 7, 15, 17, 18, 24, 26, 40, 44, 45, and 56 of the Guidelines, which were originally issued on June 18, 2026, and clarified via a Clarification Note on June 26 of the same year.

Extended Calendars

The new calendars for the Migration Procedure, provided for in articles 17 and 18 of the Guidelines, run from June 19, 2026, to October 6, 2028, with staggered stages:

• First stage (registration of expression of interest): June 19 to December 18, 2026.
• Second stage (submission of the migration request): September 21, 2026, to January 15, 2027.
• Third stage (prevention and admission period): January 18 to March 26, 2027.
• Fourth stage (resolution by the CNE Technical Committee and granting of the permit): March 29 to May 14, 2027.
• Eighth stage (formalization of the interconnection or connection contract): September 4 to October 6, 2028.
• Ninth stage (start of operation in the Wholesale Electricity Market): October 6, 2028.

Certainty for Power Plants and Load Centers

The agreement specifies the metering equipment requirements for Load Centers and details the conditions for advancing the Minimum Operational Tests provided for in the calendars. It also provides certainty regarding the electricity supply when the migration of Load Centers is not completed and allows the continued use of metering equipment that complies with the Market Rules.

In the case of operational Power Plants, up to fifteen years may be added to the validity of the generation permit granted, not exceeding thirty years in total, subject to the submission of a Modernization Program to the CNE that certifies the reliable, efficient, and safe operation of the plant.

Transitional Rules

The Tenth Transitory Provision establishes that migration requests submitted to the National Energy Commission regarding Legacy Figures expiring before March 29, 2027, must be resolved under the conditions of administrative simplification and technical agility of the Guidelines. The Second Transitory Provision obliges those who have already registered their expression of interest or submitted a request to confirm, within a period not exceeding 10 business days, their intention to continue with the procedure according to the current deadlines.

The extension of deadlines responds to the need expressed by various sector participants to have more time to carry out the necessary corporate and contractual arrangements, preserving the orderly processing of the procedures and guaranteeing the uninterrupted operation and control of the National Electric System.
