ENACOM fines FM Senegal 500 thousand pesos for aerial interference

The National Communications Entity (ENACOM) imposed a fine of 500,000 pesos on the license holder of the radio station FM SENEGAL for generating non-essential emissions that interfered with the Aeronautical Mobile Service band, a risk to air traffic safety. The sanction was ordered through Provision DI-2026-1193-APN-DNSYAUYP#ENACOM, dated July 13, 2026, and was made known through a notification edict published in the Official Gazette of the Argentine Republic on August 20, 2026.

The measure applies to María Bernarda TINETTI (C.U.I.T. No. 27-28012584-4), holder of the license for the audiovisual communication service of sound broadcasting by frequency modulation identified with the distinctive signal LRM318, which operates under the name FM SENEGAL on the frequency 102.7 MHz, from the city of Vedia, province of Buenos Aires.

The Infraction

According to file EX-2022-29853484-APN-SDYME#ENACOM, on April 9, 2022, the station generated non-essential emissions in the frequency spectrum between 129.000 and 135.500 MHz, within the band attributed to the Aeronautical Mobile Service (117.975 to 136.000 MHz). These emissions caused harmful interference on the 134.500 MHz frequency, used by the Ezeiza International Airport for air traffic control.

The conduct was classified as an infringement of Article 104, subsection c) of Law No. 26,522, which regulates audiovisual communication services. The amount of the fine was set in accordance with Article 6 of Annex I of Resolution No. 661-AFSCA/14, as amended by RESOL-2022-589-APN-ENACOM#JGM.

Deadlines and Scope of the Sanction

The resolution establishes the conditions for compliance with the sanction:

• The sanctioned party must make the payment of the fine within ten (10) business days from the date of notification.
• It is ordered to notify María Bernarda TINETTI and communicate the measure to the National Directorate of Control and Oversight, the National Directorate of Licenses, Authorizations and Registries, and the General Directorate of Administration.
• Once the procedure is completed, the file shall be archived.

The edict was signed by Juan Martín OZORES, Interventor of ENACOM, and subscribed by María Florencia Torres Brizuela, Head of the Dispatch Area.

Relevance of the Measure

The sanction underscores the gravity of interference on frequencies reserved for air navigation, the disruption of which can compromise traffic control communications at high-operation airports such as Ezeiza. For broadcasting operators, this case serves as a reminder that emissions outside authorized parameters not only violate audiovisual regulations but can also jeopardize flight safety and lead to significant economic sanctions.
