EMVICESA creará un parque de viviendas para realojos por emergencia social.

The Autonomous City of Ceuta has commissioned the public company EMVICESA to create a housing stock to meet relocation needs arising from social emergency situations. The assignment is formalized in Decree 579, signed on 7 August 2026 by the Minister for the Environment, Urban Services and Housing, Alejandro Ramírez Hurtado, and published in the Official Gazette of the Autonomous City of Ceuta No. 6,643, of 14 August 2026, with a budget of €100,000.

The decree is based on the needs report issued on 29 July 2026, which notes the insufficient resources of the Housing Office to undertake the task, and on the official letters from EMVICESA and the Heritage Office certifying the unavailability of housing. The City resorts to the in-house award mechanism, regulated in Article 32 of Law 9/2017, of 8 November, on Public Sector Contracts, and enabled by Article 86.2 of Law 40/2015, of 1 October, on the Legal Regime of the Public Sector, considering this route more efficient and cost-effective than public procurement.

EMVICESA, the Municipal Housing Company of Ceuta, S.A., has recognized in its bylaws (Article 1) its status as an in-house instrumentality and technical service of the public administrations, including the Autonomous City. Its corporate purpose includes the study, promotion and construction of publicly protected housing, the selection of awardees and the management of the housing stock, so the entrusted service falls fully within its functions. The competence in housing matters corresponds to the Ministry of Development, Environment and Urban Services, and its head exercises it by virtue of the Presidency Decree of 8 July 2025.

Financing under the State Housing Plan

The assignment will be financed from budget line 48004/1521/007 “State Housing Plan 2026-2030” of the General Budgets of the Autonomous City of Ceuta, in an amount of one hundred thousand euros (€100,000). The appropriation may be increased, after processing the appropriate budget modifications, when the concurrent circumstances and duly justified housing needs indicate that the initially planned amount is insufficient.

The tasks entrusted to EMVICESA

According to the resolution, the public company must carry out the following tasks:

• Technical and material assistance in the procedure for the acquisition and making available to the City of housing, both public and private, under any legal regime admissible in law.
• Processing of appraisals, valuations and reports, and tendering and promotion of all necessary actions until their resolution and award.
• Submission to the contracting authority of a final report describing the tasks carried out and their outcome, for its control and acceptance.

Timeframe, publicity and appeals

The duration of the assignment shall be that of the tendering procedure for obtaining real estate resources, counted from its approval, and may end early for reasons of public interest. The assignment does not involve the transfer of ownership of the competence or its substantive elements. The resolution, which exhausts the administrative route, must be published in the BOCCE, on the City’s website and on the contracting platform, in accordance with article 63.6 of the LCSP; against it, an optional appeal for reconsideration may be lodged within one month, or direct challenge before the Administrative Litigation Court of Ceuta within two months.

With this action, the City provides its public company with tools to expand the available housing stock and provide an agile response to Ceuta families at risk of exclusion who require immediate rehousing. Direct management through an in-house means and the possibility of extending credit are intended to ensure that the response arrives with the speed required by situations of social emergency.
