The Regional Teaching Federation of Comisiones Obreras has challenged in court the Instructions of June 30, 2026, issued by the Vice-Ministry of Educational Policy and Organization regarding the start of the 2026-2027 school year in non-university public educational centers in the Community of Madrid. The High Court of Justice of Madrid has urged the Community to summon all those who hold the status of interested parties in Ordinary Procedure 1147/2026. The summons is published in BOCM No. 249, dated October 19, 2026, in section I.D (Announcements) of the Ministry of Education, Science, and Universities, under the official reference BOCM-20261019-33.

The summons and its procedural origin

The Resolution of October 1, 2026, signed by the Vice-Minister of Educational Policy and Organization, José Carlos Fernández Borreguero, complies with the judicial mandate issued by the Eighth Section of the Contentious-Administrative Chamber of the High Court of Justice of Madrid. That body sent a writing dated September 17, 2026, in which it required the regional Administration to carry out the summons provided for in the procedure.

The object of the litigation is the instruction ordering the launch of the school year in the non-university public network, an organizational document that sets the application guidelines for schools and institutes dependent on the Community. The published resolution does not evaluate the merits of the case nor does it suspend the application of the instruction: it is limited to ensuring that third parties with a legitimate interest can appear in the process already initiated by the union.

Deadline, venue, and conditions for appearance

The resolution specifies the conditions of the summons:

  • Deadline: nine days to formalize the appearance.
  • Body before which to appear: the Eighth Section of the Contentious-Administrative Chamber of the High Court of Justice of Madrid.
  • Venue: General Castaños Street, number 1, 1st floor, 28004 Madrid.
  • Subjective scope: all possible interested parties in Ordinary Procedure 1147/2026, without the announcement identifying specific groups.
  • Administrative file reference: (03/16.443/26).

The text does not detail the operative content of the challenged instructions nor the prayer of the appeal, so the available information is limited to the existence of the procedure and the opening of the appearance process.

A second judicial front opened this month

The announcement of October 19 is not the only one of this nature published by the Ministry in recent weeks. BOCM no. 239, dated October 7, 2026, included a resolution dated September 24, 2026, from the Director General of Early Childhood, Primary, and Special Education, José Ignacio Martín Blasco, which similarly summoned interested parties regarding another contentious-administrative appeal filed by the same union.

In this second case, the object of the litigation is the authorization of 49 Early Childhood and Primary Education schools to provide Compulsory Secondary Education, and the processed procedure is 1208/2026, also before the Eighth Section of the High Court of Justice of Madrid, with an identical deadline of nine days and the same judicial venue.

Both announcements depict a judicial offensive by the teachers’ union on two simultaneous fronts: the organization of the start of the school year in public centers and the extension of the secondary stage in Early Childhood and Primary schools.

Why it affects teachers, families, and centers

The challenged instruction is the framework to which management teams refer to organize schedules, groupings, and organizational decisions for the recently started school year; therefore, any judicial ruling on it directly impacts the daily life of the centers. The opening of the appearance period allows unions, family associations, local entities, or any group with a legitimate interest to join the proceedings and defend their position before the court resolves. The published resolution does not anticipate deadlines for the sentence nor adopt precautionary measures, meaning that the instructions of June 30, 2026, remain in effect while Ordinary Procedure 1147/2026 is processed.
