EMAPAG EP issues new drinking water regulation in Guayaquil

The Board of Directors of the Municipal Drinking Water and Sewerage Company of Guayaquil (EMAPAG EP) approved Resolution No. 6.30.07-2026, which issues the Internal Regulation for the Management of Drinking Water, Sanitary Sewerage, and Storm Drainage Services in the canton of Guayaquil. The regulation was published in Special Edition No. 1613 of the Official Registry, consisting of 115 pages, issued in Quito on Wednesday, September 2, 2026, and will enter into force upon its publication, with a period of up to 90 days for its application by the concessionaire.
The regulation governs the relationship between EMAPAG EP, the concessionaire International Water Services (Guayaquil) INTERAGUA C. Ltda., and the users, within the framework of the Concession Contract for public drinking water and sanitation services of Guayaquil, signed on April 11, 2001, between the then ECAPAG and INTERAGUA. The regulation was approved during the Seventh Ordinary Session of the Board, held on July 30, 2026, following a review process coordinated by the Directorate of Community Liaison and User Service and validated by the concessionaire.
Scope and Reach of the Service
The regulation applies to the urban area of the city of Guayaquil and the rural parishes listed in Annex 3 of the Concession Contract:
- Juan Gómez Rendón (Progreso)
- El Morro
- Posorja
- Puná
- Tenguel
Under the responsibility of INTERAGUA are the abstraction, production, transport, distribution, and commercialization of drinking water; the collection, conveyance, treatment, and final disposal of wastewater; and the collection, conveyance, and disposal of rainwater. The use of the services is mandatory for every regularized property with access to the concession’s infrastructure.
Rates, Deadlines, and User Service
Annex III of the regulation sets the values for administrative, technical, and special services, which will be updated annually according to the Consumer Price Index (CPI). 21.70% of the revenue generated by these services will be allocated to EMAPAG EP to finance system improvement and social interest programs. Annex II specifies the infractions and sanctions for users, including compensation for damages to the company.
The regulation establishes specific service deadlines:
- Service connection: 15 days from the payment of the connection cost.
- Reconnection after suspension: 24 business hours (up to 7 days for hard cuts).
- Billing claims: up to 60 days from the invoice due date.
- Administrative claim before EMAPAG EP: resolution within a maximum of 30 days.
Rights and Sanctions
Users will be able to submit technical or commercial requests and claims without being required to be up to date with payments, and a lack of attention within the deadline will be understood as a favorable acceptance of the claim. Sanctions will be applied through a procedure that guarantees the right to a defense, with fines graduated according to the severity of the infringement and the possibility of an administrative claim before EMAPAG EP.
The resolution was certified by Attorney Alex Ramírez Estrella, Ad Hoc Secretary of the Board, and signed in the city of Guayaquil during the Seventh Ordinary Session of the Board of EMAPAG EP.
The new regulation directly affects the millions of users of the drinking water and sanitation service in the Guayaquil canton, by establishing tariffs, response times, claim rights, and a sanctioning regime that seeks to improve the quality and transparency of an essential service for the most populated city in Ecuador.
