The TSJC will review the list of aid beneficiaries for Tajogaite

The Ministry of Presidency, Public Administrations, Justice and Security of the Government of the Canary Islands has agreed to remit to the High Court of Justice of the Canary Islands the administrative file of the fundamental rights procedure no. 256/2026, filed by Ms. Alicia Vanoostende Simili. The decision is formalized through the Order of August 20, 2026, published in the Official Gazette of the Canary Islands no. 168, of August 21, 2026, in section V of Announcements.

The appeal is directed against the response letter to the interested party’s request to obtain the “list of beneficiaries of subsidies to compensate for losses caused by the Tajogaite Volcano in primary residences, secondary residences, agricultural holdings, and commercial and industrial activities,” including the name of the beneficiary, amount, payment date, and concept (reference 11L/SD-3552).

Object of the procedure

Fundamental rights procedure no. 256/2026 is being processed before the Contentious-Administrative Chamber, Second Section, of the High Court of Justice of the Canary Islands, based in Santa Cruz de Tenerife. The claim affects the beneficiaries included in the economic compensation and reparation plan for damages caused by the volcanic eruption executed by the Government of the Canary Islands.

The remittance is based on articles 4 and 45.1.a) of Law 39/2015, of October 1, on the Common Administrative Procedure, and article 116 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.

Deadline for appearance

The resolution summons anyone who may be interested in the appeal to appear and present themselves before the Court within a period of five (5) days starting from the day following the publication in the Official Gazette of the Canary Islands. Interested parties may access a copy of the filing document by requesting it in advance via the email address recuperacionlapalma@gobiernodecanarias.org.

Agreed steps

The Order provides for three actions:

• Remit the administrative file to the Contentious-Administrative Chamber, Second Section, of the High Court of Justice of the Canary Islands.
• Summon potential interested parties for their appearance within five days.
• Remit the proceedings to the Vice-Ministry of Legal Services.

The resolution, signed in Santa Cruz de Tenerife on August 20, 2026, by the Minister Nieves Lady Barreto Hernández, is published on pages 32863 and 32864 of the gazette.

Relevance

The publication opens the way for the High Court of Justice of the Canary Islands to rule on the transparency of the Tajogaite volcano aid, a matter of great public interest due to the number of affected people and the amount of compensation. The judicial decision may determine whether the list of beneficiaries must be made public, including the name, amount, and payment date of each grant.
