The Regional Government of Extremadura (Junta de Extremadura) has ordered the execution of judgment no. 106/2026, dated February 11, issued by the Contentious-Administrative Chamber of the High Court of Justice of Extremadura, which annulled the revocation of a grant of 5,670 euros to a private individual. The resolution, signed on September 10, 2026, by the General Secretariat for Economy, Business, and Trade, is published in the Official Gazette of Extremadura (Diario Oficial de Extremadura) no. 210, dated October 30, 2026, under official reference 2026062717.
A revocation annulled by the courts
The ruling upholds contentious-administrative appeal no. 501/2025, filed by the legal representation of Manuel Monterrubio Millán, represented by the court agent María del Pilar Guerrero Cruz, and directed against the Regional Government of Extremadura. The judgment annuls the Resolution of June 2, 2025, from the Directorate General for Business, which had declared the revocation of 5,670 euros corresponding to a grant awarded via a resolution from the same management center dated December 18, 2024.
The text of the ruling, reproduced in full in the published resolution, states: “We uphold the appeal filed (…) against the Resolution of the Directorate General for Business of the Regional Government of Extremadura dated June 2, 2025, revoking grants, which we annul along with all legal consequences thereof. No costs.” The fourth legal ground of the judgment expressly excludes the imposition of costs on the administration.
Finality and distribution of competence
The process leading to the execution is detailed in the resolution itself:
- February 11, 2026: judgment no. 106/2026 is issued by the Contentious-Administrative Chamber.
- May 7, 2026: a decree declares the judgment final.
- June 2, 2026: the General Counsel (Abogacía General) of the Regional Government reports that the judgment has become fully enforceable.
- September 10, 2026: the resolution ordering the ruling to be carried out to its full and due effect is issued in Mérida.
According to Article 40.1 of the Organization and Operation Regulations of the General Counsel of the Regional Government of Extremadura, approved by Decree 1/2022 of January 12, the competence for material execution corresponds to the body that is competent by reason of the subject matter. In this case, the Secretary General of the Department of Economy, Employment, and Digital Transformation, a competence delegated to the General Secretariat for Economy, Business, and Trade by the Resolution of May 9, 2026 (DOE no. 90, dated May 13).
Mandatory publication of the ruling
The resolution invokes Article 9 of Decree 59/1991, of July 23, which regulates administrative processing in the execution of judicial resolutions. This regulation obliges the competent body to issue a compliance resolution and to publish it in the Official Gazette of Extremadura when the judgment annuls or modifies the contested act, provided that the data of the plaintiff and defendant, the case number, and the content of the ruling are inserted, with express mention of its finality.
The document is signed by Juan Andrés Moreno Martín, Secretary General, acting as a substitute by the Resolution of May 8, 2026 (DOE no. 90, of May 13).
A precedent on the control of repayments
The publication closes a conflict of nearly a year and a half between the granting of the aid, in December 2024, and the judicial annulment of its revocation, in February 2026. For beneficiaries of regional subsidies, the case confirms that revocation agreements issued by the General Directorate of Enterprise are subject to full judicial control and that the administration must execute the judgment even if the amount is small. The resolution nullifies the repayment of 5,670 euros and obliges the Junta de Extremadura to assume the legal costs.
