The High Court of Justice orders the registration of two police officers from Candeleda
Por FactBox Admin

The High Court of Justice of Castilla y León has annulled the administrative silences of the Candeleda City Council and has recognized the right of two officers to register in the Registry of Local Police of Castilla y León and of eight others to renew their professional identity cards. The ruling, now final, is published in the Official Gazette of Castilla y León no. 198, dated October 13, 2026, by resolution of the Civil Protection and Emergencies Agency (reference BOCYL-D-13102026-198-1).
The Resolution of October 6, 2026, from the Civil Protection and Emergencies Agency, provides for the publication of the ruling of judgment no. 329/2026, dated March 26, issued in ordinary procedure 0000911/2024 by the Administrative Litigation Chamber of the High Court of Justice of Castilla y León, based in Valladolid. The published text declares the resolution final as of June 1, 2026, although at that point it cites judgment no. 392/2026, also dated March 26.
The publication is agreed upon under article 118 of the Constitution, 17.2 of the Organic Law of the Judiciary, and 72.2 of the Law Regulating Administrative Litigation Jurisdiction, for general knowledge and compliance. The document appears in section I, B.1 (Appointments, Situations and Incidents), pages 7 and 8, and is signed in Valladolid on October 6, 2026, by the Director of the Agency, Irene Cortés Calvo.
The annulled silences and registrations
The ruling partially grants the administrative litigation appeal filed by the legal representation of the Candeleda City Council against the negative administrative silences identified in the first legal ground, and annuls them for not being in accordance with the Law.
As a consequence, it recognizes the right to register in the Registry of Local Police of Castilla y León for:
- Diego Alonso Díaz
- Julián Martos Martínez
Both must also be issued the corresponding professional identity card, under the parameters set in the third legal ground of the resolution.
Eight professional card renewals
The judicial pronouncement also protects eight other officers from the municipality, recognizing their right to the renewal of their professional identity cards, likewise in accordance with the third legal ground:
- Christian Saguar Rodríguez
- Estela Sánches Jiménez
- Jaime Gómez Delgado
- Luis Javier González Pérez
- Sergio Cano López
- Roberto Sánchez Gómez
- Rubén Prieto Franco
- Javier González Blázquez
The judgment is issued without the imposition of costs, according to the fifth point of the ruling.
Publication and effects
The insertion of the ruling in the official gazette responds to the obligation to publicize final judicial resolutions affecting administrative acts, so that the Administration and the interested parties may align their actions with the content of the pronouncement.
The full text of the ruling is reproduced literally in the resolution, which closes with the official reference BOCYL-D-13102026-198-1 and the gazette’s imprint (D.L. BU 10-1979, ISSN 1989-8959).
The case sets a precedent regarding the consequences of municipal administrative silence in matters of local policing: the High Court of Justice of Castilla y León not only corrects the inactivity of the Candeleda City Council, but also establishes the right of ten officers to complete their registration and professional status. The municipal staff is thus left with two registrations pending formalization and eight professional cards to be renewed, in a pronouncement that may serve as a reference for other city councils with similar files.
