The Court of Cartagena summons interested parties regarding the San Javier land redistribution

The Official Gazette of the Region of Murcia publishes in issue number 190, dated August 19, 2026, the announcement from the San Javier City Council summoning those interested in ordinary procedure 506/2025, conducted before the Court of First Instance, Contentious-Administrative Section, Plaza n.º 1 of Cartagena. The appeal has been filed by Mr. Francisco Javier González Soler against Mayoral Decree number 4538/2025, dated July 22, 2025.

The appealed decree grants final approval to the Action Program, the Reparceling Project, and the Urbanization Project of Action Units number 3A and 3B of the municipality’s subsidiary planning regulations. The announcement, signed by Mayor José Miguel Luengo Gallego in San Javier on August 4, 2026, is published under official reference NPE A-190826-4073, on page 19647.

Summoning of interested parties

Pursuant to Article 49.2 of Law 29/1998, of July 13, Regulating Contentious-Administrative Jurisdiction, in relation to Article 45 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, the outcome of the procedure may affect other interested parties. Therefore, they are hereby notified that they have nine days to appear and present themselves before the indicated Court, if it is in their legal interest, complying with the established legal formalities and prescriptions.

The announcement specifies the consequences of appearing after the deadline or the failure to appear:

• Anyone who appears after the established deadline will be considered a party, without this retroacting or interrupting the course of the procedure.
• Anyone who does not appear in a timely manner will see the procedure continue through its stages, without any notification of any kind being issued to them.

Object of the litigation

The appeal challenges the final approval of the urban management instruments for Action Units 3A and 3B, which include the action program, the reparceling of the affected estates, and the urbanization project. The reparceling redistributes the land and urban burdens among the owners included in the scope; therefore, the judicial resolution may directly affect the rights of those who are interested parties in said units.
