SESPA appoints permanent staff in two categories following TSJA rulings

The Health Service of the Principality of Asturias (SESPA) has appointed two candidates as permanent statutory staff in the categories of Higher Qualified Technical Personnel and Nurse, in execution of two rulings from the High Court of Justice of Asturias (TSJA). The resolutions, signed by the organization’s Management Directorate on October 1, 2026, are published in the Official Gazette of the Principality of Asturias (BOPA) no. 205, dated October 22, 2026, with official references 2026-08359 and 2026-08360.

Both appointments fill positions from the merit-based competition convened by the Resolution of the SESPA Management Directorate of December 15, 2022 (BOPA of December 27, 2022), under the sixth and eighth additional provisions of Law 20/2021, of December 28, on urgent measures for the reduction of temporary employment in the public sector. The call was issued in compliance with the Agreement of May 27, 2022, of the Governing Council of the Principality, which approved the extraordinary public employment offer for stabilization.

The two resolutions invoke the twelfth.2 basis of the call and the powers of article 128.3.c) of the Principality of Asturias Law 7/2019, of March 29, on Health. In both cases, the prior procedure consisted of the selection of the position, the submission of the mandatory documentation, and its verification by the health service.

Higher Qualified Technical Personnel: ruling 379/2025 and change of destination

Resolution 2026-08359 complies with ruling no. 379, of April 15, 2025, of the Contentious-Administrative Chamber of the TSJA, corresponding to ordinary procedure 614/2024. The selection process was for 24 positions of Higher Qualified Technical Personnel: 22 from the open access-general quota and 2 from the open access-disability quota.

The appointment is granted to Ana Tuñón Torrealdea, with a position in Health Area IV of SESPA. The resolution simultaneously annuls the previous appointment of the same candidate as Technical Group of the Administrative Function in Health Area I, awarded by Resolution of June 19, 2025 (BOPA of July 17, 2025), as it is not legally possible to obtain two positions in the same selection process.

Nurse: ruling 588/2026 and position in Health Area VIII

Resolution 2026-08360 executes ruling no. 588, of June 23, 2026, of the First Section of the Contentious-Administrative Chamber of the TSJA, corresponding to ordinary procedure 799/2025. The reference call included 959 Nurse positions: 928 open access-general quota and 31 open access-disability.

The appointment corresponds to Lucía González Fenor, with a position in Health Area VIII of SESPA.

Deadlines and conditions for taking office

• The taking of office must be formalized at the Management of the Health Area of the awarded position within one month from the day following the publication in the BOPA.
• Failure to report for duty attributable to the interested party and without justified cause results in the forfeiture of the rights derived from their participation in the competition.
• Taking office is not permitted if the applicant holds a permanent statutory appointment of the same category or specialty within the National Health System.
• Taking office as a permanent employee prevents the occupation of another position of a different category derived from the stabilization processes of Law 20/2021.
• Those who already hold a permanent position in another category may opt for a leave of absence to provide services in the public sector, in accordance with article 66.1.a) of Law 55/2003, of December 16, of the Framework Statute.
• The deadlines for taking office are governed by article 6 of Decree 50/2019, of June 21.

Appeal Process

Against both resolutions, which do not exhaust the administrative route, an administrative appeal (recurso de alzada) may be filed before the Regional Ministry of Health within one month from the day following their publication, in accordance with article 134 of Law 7/2019 and article 121 of Law 39/2015, of October 1.

The two appointments confirm that the stabilization of temporary staff in the SESPA continues to depend on the execution of judicial rulings: each judgment from the TSJA forces the reopening of the position selection and the resolution of individual cases years after the 2022 call. For the affected applicants, the publication in the BOPA activates a one-month deadline for taking office which, if not met, renders the appointment null and void.
