The SESPA appoints permanent statutory staff in the Laboratory following a TSJA ruling

The Management Directorate of the Health Service of the Principality of Asturias (SESPA) has resolved to appoint permanent statutory personnel in the category of Laboratory Specialist Technician and to award the corresponding position in Health Area V. The decision is adopted in execution of judgment no. 1018 of November 18, 2025, from the Contentious-Administrative Chamber of the High Court of Justice of Asturias (TSJA), and is published in the Official Gazette of the Principality of Asturias (BOPA) no. 183 of September 22, 2026, with official reference 2026-07517.

The resolution and its judicial origin

The Resolution of August 31, 2026, from the Management Directorate of SESPA, complies with the judgment issued in ordinary procedure 527/2025 by the Contentious-Administrative Chamber of the TSJA. The act is supported by the Twelfth.2 clause of the call for applications and the powers attributed by article 128.3.c) of the Law of the Principality of Asturias 7/2019, of March 29, on Health.

The original selection process is the merit competition convened by Resolution of December 15, 2022 (BOPA of December 27, 2022), issued under the sixth and eighth additional provisions of Law 20/2021, of December 28. According to the published text, once the choice of position, the deadline for submission of documentation, and its verification were completed, the listed applicant meets the requirements to be appointed as permanent statutory personnel in this category.

Appointment and destination

The first section of the resolution specifies the appointment and the awarded destination:

• Appointed person: Ms. Alicia Alonso Nicolás, with DNI *7189.
• Category: Laboratory Specialist Technician of SESPA.
• Destination: Health Area V-Health Service Area of the Principality of Asturias.
• Access system: merit competition, with appointment as permanent statutory personnel.

Deadlines, requirements, and appeals

The awardee must take office at the Management of the Health Area of the awarded position within one month, counted from the day following the publication of the resolution in the BOPA. Failure to join within that period, when attributable to the interested party and not due to justified causes, will result in the forfeiture of the rights derived from her participation in the competition and will nullify the appointment, in accordance with the twelfth clause of the call for applications and article 6 of Decree 50/2019, of June 21.

The resolution also sets limits and options for the appointed person:

• You may not take office if you hold a fixed statutory appointment of the same category and/or specialty within the National Health System, according to the fifth basis 1.1 e) of the call for applications.
• Taking office as a permanent employee in this category prevents taking office in any position of another category derived from stabilization processes under Law 20/2021, of December 28.
• If you already hold a permanent position in another category, you may opt for a leave of absence to provide services in the public sector in one of them, in application of article 66.1.a) of Law 55/2003, of December 16, of the Framework Statute of statutory personnel of health services; in the absence of an express option, the leave of absence in the original category shall be understood as requested.

Against the resolution, which does not end the administrative route, an administrative appeal (recurso de alzada) may be filed before the Regional Ministry of Health within one month from the day following its publication, in accordance with article 134 of Law 7/2019, of March 29, on Health, article 27.2 of Law 2/1995, of March 13, on the Legal Regime of the Administration of the Principality of Asturias, and article 121 of Law 39/2015, of October 1. The document appears signed in Oviedo on August 31, 2026, by the Managing Director.

Scope of the process

The appointment is part of a competition that called for 93 positions in the category of Laboratory Specialist Technician: 87 corresponding to the open access-general quota and 6 to the open access-disability quota. The published resolution therefore affects the applicants of that stabilization process, who see how the judicial execution of the TSJA ruling translates into an effective appointment and the allocation of a specific destination in Health Area V.
