The SES refers the appeal against the Nursing job bank to Badajoz
Por FactBox Admin

The General Directorate of Human Resources of the Extremadura Health Service (SES) has agreed to the referral to the Court of First Instance, Contentious-Administrative Section, Plaza n.º 1, Badajoz, of the administrative file of the contentious-administrative appeal processed under abbreviated procedure no. 127/2026. The decision is formalized in the Resolution of October 1, 2026, published in the Official Gazette of Extremadura (DOE) number 196, of October 9, 2026, with official reference 2026062524. The same announcement summons potential interested parties to appear before the court within nine days.
The appeal is directed against the presumed dismissals by administrative silence of the optional appeals for reversal filed against two resolutions of the SES Management Directorate, both dated February 24, 2026, which made public the final lists of applicants admitted and excluded from the Nursing job bank. The referral of the file is agreed in accordance with the provisions of articles 48 and 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction, and in compliance with the request made by the judicial body.
Who is appealing and what is being challenged
Abbreviated procedure 127/2026 has been promoted by Ms. Carmen Generelo Moreno, according to the official text of the resolution. The challenge is directed against the final lists derived from the merit valuation update cutoff of September 30, 2025, corresponding to two different categories:
- Job bank for the category of Nurse and for Special Characteristics Units of this category.
- Job bank for the category of Specialist Nurse in Family and Community Nursing.
In both cases, the challenged resolution is that of February 24, 2026, from the SES Management Directorate, by which the final lists of admitted and excluded applicants were made public. The prior administrative route was exhausted with optional appeals for reversal that did not receive an express response, leading to the dismissal by administrative silence now being discussed before the contentious-administrative jurisdiction.
Nine-day period to appear
The resolution summons potential interested parties in the procedure so that they may appear before the Court of First Instance of Badajoz, if it serves their legal interests, within a period of nine days counted from the day following the publication of the announcement in the DOE. The text warns that, if they appear outside the indicated period, they will be considered a party only for the non-precluded proceedings, and the procedure will continue through its steps without the need to provide notifications in court or in any other form.
The resolution was signed in Mérida on October 1, 2026, by the Director General of Human Resources, José Antonio Bote Paz.
Background: another similar appeal in Cáceres
The challenge to the Nursing pool lists is not an isolated case. DOE number 180, dated September 17, 2026, published the Resolution of September 11, 2026, from the General Directorate of Human Resources, by which the file for summary procedure no. 120/2026 was forwarded, filed before the Court of First Instance, Plaza no. 2, of Cáceres, and promoted by Ms. Lidia Gómez González. That appeal was directed against the dismissal by administrative silence of the appeal for reversal filed on June 6, 2025, against the Resolution of May 6, 2025, of the Management Directorate, regarding the final lists of the merit assessment cutoff of September 30, 2024, in the Nurse and Special Characteristics Units pool, convened by Resolution of September 23, 2014.
The pattern repeats: individual appeals from applicants against the final lists of health pools, processed via summary procedure and with a general summons to interested third parties through an announcement in the official gazette.
Impact
The publication affects all applicants participating in or who may be affected by the final lists of the Nursing and Family and Community Nursing pools of the SES, as the outcome of summary procedure 127/2026 may impact the validity of the merit assessment of the September 30, 2025 cutoff. Interested parties have a brief period, only nine days from the day following publication, to decide whether to appear before the Court of First Instance of Badajoz and defend their position in the process.
