El SES ejecuta la sentencia sobre el nombramiento temporal de una enfermera

The Extremadura Health Service (SES) has arranged for the execution of judgment no. 323/2026, issued by the Contentious-Administrative Chamber of the High Court of Justice of Extremadura, which annuls the decision not to grant full effects to the temporary appointment of a nurse. The resolution, from the General Directorate of Human Resources of the SES, is published in the Official Gazette of Extremadura no. 188, of September 29, 2026, with the official reference 2026062417. The ruling obliges the health organization to recognize administrative, labor, and economic effects for the period worked in 2015.

Judgment no. 323/2026, of May 19, 2026, upheld appeal no. 59/2026 filed by Noelia Romero Murillo against judgment no. 110/2025, of December 4, 2025, from the Contentious-Administrative Court no. 1 of Badajoz, issued in abbreviated procedure no. 122/2025. The origin of the litigation is the dismissal by administrative silence of the request for the review of acts null and void by law that the interested party submitted on October 31, 2024.

In that request, she asked that the decision not to grant full effects to the temporary appointment she accepted as a nurse in the Management of the Badajoz Health Area between June 2, 2015, and September 30, 2015, be declared contrary to law due to discrimination. The Chamber revoked the lower court’s judgment and ruled against the SES.

The ruling: full administrative, labor, and economic effects

The literal wording of the judgment orders the SES to “grant full effects (administrative, labor, and economic) to the appointment accepted by Ms. Noelia Romero Murillo to work in the Management of the Badajoz Health Area from 06/02/2015 to 09/30/2015”.

Furthermore, the ruling imposes three specific actions:

  • Process the registration of the interested party in the Social Security system.
  • Count said period as merit for all types of selection processes.
  • Count it for the purposes of triennials (three-year seniority increments) and professional career.

The SES resolution recalls that the judgment became final according to the official letter of September 7, 2026, sent by the Lower Court, Contentious-Administrative Section, Plaza no. 1, of Badajoz.

The material execution of final judgments corresponds, according to article 40.1 of the Regulations approved by Decree 1/2022, of January 12, to the body that is competent by reason of the subject matter of the litigation. The SES also applies articles 8 and following of Decree 59/1991, of July 23, which regulates the administrative processing in the execution of judicial resolutions.

The resolution is structured into four sections: executing the judgment, carrying out all necessary actions for its correct and complete execution, publishing it in the DOE, and leaving open the path for the incident provided for in Article 109 of Law 29/1998, of July 13, regulating Contentious-Administrative Jurisdiction.

Who is involved

  • Executing body: General Directorate of Human Resources of the Extremadura Health Service.
  • Signatory: José Antonio Bote Paz, General Director of Human Resources.
  • Plaintiff: Noelia Romero Murillo.
  • Procedural representation: court representative Petra Aranda Tellez and lawyer M.ª Ángeles Calzadilla Gamero.
  • Judicial bodies: Contentious-Administrative Chamber of the TSJEx and Contentious-Administrative Court No. 1 of Badajoz.

The resolution establishes a relevant criterion for healthcare personnel with temporary appointments: the time worked must produce all its effects, including economic and professional career effects, and be counted as merit in any selection process. The ruling comes after nearly two years of litigation since the initial request for review and obliges the SES to regularize the situation of the interested party.
