The SES annuls the appointment of a fifth gynecologist due to a computer error

El SES anula el nombramiento de un quinto ginecólogo por un error informático

The Extremadura Health Service (SES) has annulled the appointment as permanent statutory staff of the candidate who held fifth place in the open category for the specialty of Obstetrics and Gynecology, as that position had been awarded “unduly due to a computer error.” The decision was adopted by the General Directorate of Human Resources via a resolution dated October 30, 2026, published in the Official Gazette of Extremadura (DOE) number 212, on Wednesday, November 4, 2026, with official reference 2026062807.

The resolution corrects that of October 22, 2026 (2026062710), published in DOE number 210 on October 30, which had appointed permanent statutory staff in eleven specialties within the category of Area Specialist Physician, including Obstetrics and Gynecology. The issuing body is the General Directorate of Human Resources of the SES, based in Mérida, and the text is signed by its head, José Antonio Bote Paz.

From five offered positions to four appointments

The call for applications, approved by resolution on December 19, 2024, offered 5 positions with the following distribution:

  • 3 positions for the open category.
  • 1 position for the disability category.
  • 1 position for the internal promotion category.

According to the rules, vacant positions from internal promotion cannot be added to the open category, whereas those from the disability category are legally accumulated. During the process, the disability position remained vacant and was added to the open category, which increased from 3 to 4 available positions; the internal promotion position also remained vacant but had to remain unaccumulated.

The failure of the allocation program unduly added that fifth position to the open category. The result was the appointment of 5 candidates when the legal maximum was 4. The correction is supported by article 109.2 of Law 39/2015, of October 1, on the Common Administrative Procedure, and the principle of adherence to the rules of the call.

Who keeps the position and who loses it

The corrected annex limits the appointments of the open category to the first four candidates by order of score:

  • Azahara Romero Lozano, position 0300, destination Don Benito/Villanueva.
  • Pedro Miguel Eguez Macías, position 0800, destination Navalmoral de la Mata.
  • Clara Calabria Santiago, position 0400, destination Llerena/Zafra.
  • Tatiana Costas Rodríguez, position 0800, destination Navalmoral de la Mata.

The appointment of the candidate who appeared in fifth place in the list of October 22, Sofía Barahona Rondón, with position 0400 and destination Llerena/Zafra, is hereby annulled. The hospitals involved are, therefore, those of Don Benito/Villanueva, Navalmoral de la Mata, and Llerena/Zafra, the health areas to which the awarded positions were assigned.

The resolution recalls that the taking of office takes place at the Management of the corresponding Health Area and that the incorporation deadline set in the resolution of October 22 was Tuesday, November 10, 2026.

Appeal deadlines and consultation channel

Against the new resolution, which exhausts the administrative route, the following may be filed:

  • Optional appeal for reversal (recurso potestativo de reposición) before the General Directorate of Human Resources itself, within a period of one month.
  • Contentious-administrative appeal before the competent jurisdictional body, within a period of two months.

Both deadlines are counted from the day following the publication in the DOE. The modified definitive list of successful candidates can also be consulted at the SES internet address enabled for personnel selection.

The episode affects a selection process for permanent statutory personnel that had already closed and with imminent incorporations: the position that becomes free in Llerena/Zafra becomes vacant again and the excluded applicant loses an appointment that had already been published. For the candidates of the specialty, the case demonstrates that the ex officio review of one’s own act can alter already formalized awards when an error in the application of the rules is proven, and leaves the route of appeal open for the affected person.
