The Port suspends building permits in El Carmen for three years.

The City Council of El Puerto de Santa María has initially approved the Detailed Study of the Macarena 11 and 13 plots, included in Execution Unit S-NO-12 “El Carmen”, and has agreed to suspend, for a maximum period of three years, the granting of planning approvals, authorisations and licences throughout that area. The decision was adopted by the Local Government Board in a session held on 23 July 2026 and is published in the Official Gazette of the Province of Cádiz (No. 154, of 12 August 2026), with document number 255.448.
The announcement is part of the processing of the Detailed Study for the area comprising plots “A-6-7-A”, “A-6-7-B”, “A-6-7-C”, “A-6-7-D”, “A-6-7-E” and “A-6-7-F” (Macarena Nos. 11 and 13), included in Execution Unit S-NO-12 “El Carmen”. The document has been promoted by the company Construcciones Riveramol S.L. and submitted to the General Entry Register on 3 July 2026, with number 2026-E-RE-15464; the case file processed is 2025/2/S537.
A Detailed Study for the Macarena 11 and 13 plots
The Detailed Study is the planning instrument that specifies and readjusts the detailed planning of an area, including its alignments, gradients and volume arrangements. In this case, the area comprises six plots of urban land in El Puerto, integrated into the “El Carmen” execution unit:
- “A-6-7-A”
- “A-6-7-B”
- “A-6-7-C”
- “A-6-7-D”
- “A-6-7-E”
- “A-6-7-F”
The initial approval now opens the public information phase prior to the final approval of the document, which must be decided by the City Council.
Three years of suspension of licences
Along with the initial approval, the Local Government Board agreed to suspend, for a maximum period of three years, the granting of approvals, authorisations and planning licences throughout the affected area, in accordance with Article 78.2 of Law 7/2021, of 1 December, on promoting the sustainability of the territory of Andalusia (LISTA). The suspension shall in any case lapse upon the publication and entry into force of the urban planning instrument resulting from the processing.
During that period, and until the new planning is consolidated, no developments incompatible with the document being processed may be authorised in the area. The measure directly affects construction activity and the residents and property owners of the area, who will have their building projects conditioned until final approval.
In accordance with Article 112 of Decree 550/2022, of 29 November, approving the General Regulations of the LISTA, the complete file is submitted to public information for a period of twenty days, counted from the day following the publication of the notice in the Official Gazette of the Province of Cádiz. During this period, objections may be submitted:
- At the electronic registry of the headquarters of the City Council of El Puerto de Santa María.
- In any of the forms provided for in Article 16.4 of Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations.
The file is available for inspection at the offices of the Municipal Urban Planning and Management Service, at Palma Street s/n, where it may be consulted on business days and hours by prior appointment at planeamiento@elpuertodesantamaria.es; it is also available on the Transparency Portal and on the municipal website, under the tab “Public Info. Planning and Management Instruments”. The notice, signed on 30 July 2026 by the mayor-president, Germán Beardo Caro, appears on page 4 of the provincial bulletin under reference 255.448.
The resolution sets the starting point for the definitive planning of plots Macarena 11 and 13, in the area of the execution unit “El Carmen”, and freezes urban development activity in the area for a maximum of three years, which conditions the planned construction projects and the lives of local residents. Interested parties have twenty days from publication to submit objections and participate in the final definition of the document.
