The Port of Santa María suspends urban planning licenses in the Guadalete industrial estate.

The El Puerto de Santa María City Council has submitted the Detailed Study of plots in the Guadalete Industrial Estate to public information and, simultaneously, has agreed to suspend the granting of urban planning licenses throughout the entire affected area for a maximum period of three years. The Local Government Board adopted both agreements at its session of 23 July 2026, and the announcement is published in the Official Bulletin of the Province of Cádiz, number 157, of 17 August 2026.

The measure is framed within Law 7/2021, of 1 December, on promoting the sustainability of the territory of Andalusia (known as LISTA), whose Article 78.2 allows municipalities to suspend the granting of approvals, authorisations and urban planning licenses when an planning instrument is being processed. The regional regulation, developed by Decree 550/2022, of 29 November, also regulates the public information procedure for these files.

The Detailed Study was proposed on private initiative and registered with the City Council under entry number 2026-E-RE-1188, of 27 January 2026.

Suspension of licenses for a maximum of three years

The Local Government Board agreed, in accordance with Article 78.2 of the LISTA, to suspend for a maximum period of three years the granting of approvals, authorisations and urban planning licenses throughout the entire area affected by the Detailed Study. This suspension seeks to guarantee the coherence of the future planning instrument, preventing the authorisation of projects potentially incompatible with the planning that is ultimately approved.

The measure shall in any case expire upon the publication and entry into force of the urban planning instrument that resolves the procedure.

Public information: twenty days for submissions

In accordance with Article 112 of Decree 550/2022, the complete file is subject to public information for a period of twenty days, counted from the day following the publication of the announcement in the Official Bulletin of the Province of Cádiz. During that period, interested parties may submit the allegations they deem appropriate.

Allegations may be submitted through the electronic registry of the El Puerto de Santa María City Council website, or by any of the means provided for in Article 16.4 of Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations.

Relevance for property owners and developers

The suspension directly affects property owners and developers in the Guadalete industrial area, who for the next three years —or until the planning instrument is approved and published— will not be able to obtain approvals or urban planning licenses in the affected area. This is a common measure in Andalusian municipalities when processing begins for a planning instrument that may modify land use and buildability conditions.
