The PGOU of Albacete catalogs the Belda Building as a protected asset

The Regional Ministry of Development of Castilla-La Mancha has definitively approved specific modification no. 62 of the General Urban Development Plan (PGOU) of Albacete, which incorporates the Belda Building into the Catalog of Protected Assets and Spaces with environmental protection. The resolution, adopted by Order of July 31, 2026, and published in the DOCM no. 152 of August 11, 2026, is now announced in the Official Gazette of the Province of Albacete number 102, of September 2, 2026, pages 30 to 33.

The announcement, signed by the Municipal Management of Urbanism and Housing of the Albacete City Council (file 1415980P), is published in compliance with articles 42.2 of the revised text of the Law on Territorial Planning and Urban Activity of Castilla-La Mancha and 157 of Decree 248/2004, of September 14, which approves the Planning Regulations.

Processing of the specific modification

Specific modification no. 62, regarding the structural organization of the current General Plan, was initially approved by the Plenary Council in its session of June 30, 2026, and received a favorable report from the Regional Urbanism Commission on May 29, 2026. Its purpose is to incorporate the Belda Building into the municipal catalog with environmental protection, establishing volumetric conditions and uses with the delimitation of a ZOU (Urban Use Zone) in the historic center.

The new regulation is structured through Zonal Norm 13, which organizes the closed block of listed buildings with partial and environmental protection and global tertiary use. The property, located at Marqués de Molins Street, no. 16, with cadastral reference 9270010WJ9197A0001LR, is included in catalog file A-23-1.º.

Characteristics and protection conditions

According to the catalog file, the Belda Building is a construction of traditional 20th-century architecture, situated between party walls, with a sloped roof and eaves over the cornice, a symmetrical three-section facade, and cast-iron pillars on the ground floor. Its state of conservation is rated as poor, with current use for commerce and housing, and private ownership.

  • Type of protection: environmental 1.º.
  • Maximum buildability: 2,322 m².
  • Permitted alternative use: commercial tertiary in categories A, B, C, E2, E3, and E4.
  • Authorized actions: construction of an attic floor above the existing ones and recovery of the original composition of the facade openings according to the project by architect Casas Massó.
  • Constraints: historical-artistic axis and protection environments of Casa Cabot, Casa Juan López, and Casa Julia Gómez Alfaro, with mandatory consultation with the competent administration in cultural matters in accordance with Law 4/2013 on Cultural Heritage of Castilla-La Mancha.

Easements and appeals

The action is entirely affected by the aeronautical easements of the Albacete Air Base, therefore any construction, installation, or crane will require a favorable report from the Ministry of Defense (DIGENIN). Against the order of the Ministry of Public Works, which exhausts the administrative route, a contentious-administrative appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of Castilla-La Mancha within two months of its publication in the DOCM.

The entry into force of this modification reinforces the protection of the built heritage of the historic center of Albacete, guaranteeing the conservation of an emblematic building on Marqués de Molins street and regulating its tertiary use within the framework of the municipal urban planning.
