The Melilla Tourism Board accepts the resignation of its manager

The Melilla Tourism Board has accepted the resignation of Javier Mateos de Porras as Managing Director and has declared the Managing Director’s office vacant effective September 4, 2026. To fill the vacancy, the Presidency of the organization has appointed Juan Mario González Rojas, a career civil servant of subgroup A2 and current Secretary of the Melilla Monumental City Foundation, as a substitute for the vacancy and without additional remuneration. The measure is formalized in Resolution No. 0285, dated September 7, 2026, published in the Official Gazette of the Autonomous City of Melilla (BOME) number 6417, dated September 25, 2026, with reference BOME-A-2026-1073.

The Melilla Tourism Board is an autonomous body of the Autonomous City, with a distinct public legal personality, its own assets and treasury, and management autonomy, attached to the Department competent in tourism matters. Its Statutes were approved by Decree No. 1355, dated December 30, 2021, and published in BOME No. 5927, dated January 4, 2022. Article 16.2 of those Statutes attributes to the Managing Director the execution of the agreements of the Governing Board and the resolutions of the Presidency, the formulation of proposals, the ordinary direction of services, the immediate leadership of personnel, and the processing of tourism files.

The resignation was submitted in writing on September 3, 2026, under registration number 2026078136, and led to file 31260/2026. The file includes a proposal report from the Secretary of the Board—the Secretary General of the Assembly, Diego Giner Gutiérrez—dated September 22, 2026, which examines the legality of the measure and concludes that the appropriate instrument is a presidential resolution of organic substitution, complemented by the temporary accumulation of functions provided for in Article 73.2 of the Basic Statute of Public Employees.

The termination and declaration of vacancy

The operative part of Resolution No. 0285 agrees, firstly, to accept the resignation of Javier Mateos de Porras as Managing Director of the Tourism Board and declare his termination effective September 4, 2026. Secondly, it declares the position of the Managing Director’s office vacant from the effective date of termination.

The legal report emphasizes that the mere submission of the resignation is not sufficient to consider the office vacant: it is necessary for the competent body to accept the resignation, declare the termination, and set its effective date. The resolution validly combines the acceptance, the declaration of vacancy, and the appointment of the substitute to avoid any discontinuity between the termination of the holder and the start of the substitution.

Who assumes the Managing Director position

The designee is Juan Mario González Rojas, a career official of the Autonomous City of Melilla belonging to subgroup A2, who currently serves as the Secretary of the Fundación Melilla Ciudad Monumental. The report recognizes in him the qualifications, experience, and knowledge of the City’s instrumental organization suitable for the transitional exercise of these functions.

The designation is configured with the following features:

• Substitution regime due to vacancy, not an ordinary or provisional appointment.
• Very limited duration, approximately two weeks, until the incorporation of the new holder through the ordinary procedure.
• Full maintenance of his original position, administrative status, assignment, functions, and remuneration at the Foundation.
• No additional remuneration, salary difference, productivity pay, gratification, indemnity, or economic compensation of any kind.
• Action limited to ordinary and urgent management, matters subject to deadlines, and decisions whose delay would harm the Board of Trustees or third parties.

Conditions, limits, and control

The effectiveness of the measure is conditional upon the express acceptance of the interested party, the agreement of the competent body of the Fundación Melilla Ciudad Monumental regarding the compatibility of schedules and the continuity of his functions as Secretary, and a favorable report from the Department competent in public service confirming that he does not occupy a second position nor is his administrative status altered.

The resolution further imposes the duty of abstention in matters in which the Foundation is an interested party or is directly affected, as well as in any review action or appeal against acts issued by the substitute himself. All acts and signatures must identify the substitution, the substituted body, and the resolution establishing it, and it is ordered to immediately continue or initiate the ordinary appointment procedure for the new holder, report to the Governing Board in its first session, and publish the resolution in the BOME.

The text recalls as a precedent Resolution No. 27, of March 18, 2022, by which the Presidency arranged an accidental substitution of the Management-Directorate during the medical leave of its holder, and specifies that that case incorporated management personnel and remunerative effects that are now expressly excluded. Against the resolution, which does not exhaust the administrative route, an administrative appeal (recurso de alzada) may be filed within one month before the Department or before the President of the Autonomous City, with a maximum period of three months to resolve.

The publication of Resolution No. 0285 guarantees the continuity of Melilla’s tourism promotion agency during the two planned weeks of vacancy, a period in which the substitute may sign and process time-sensitive files, but may not make strategic decisions or long-term commitments. The ordinary procedure for electing the new Managing Director remains open, with the Governing Board and the Presidency as key components of the appointment.
